I keep thinking of centurys iirc death of cinderella post it was damn near the most perfect thing ive ever read on the internet it was true and now.... Im depressed again.

KRS 67.083(6):

"If a county is authorized to regulate an area which the state also regulates, the county government may regulate the area only by enacting ordinances which are consistent with state law or administrative regulation..."

KRS 82.082:

"(1) A city may exercise any power and perform any function within its boundaries, including the power of eminent domain in accordance with the provisions of the Eminent Domain Act of Kentucky, that is in furtherance of a public purpose of the city and not in conflict with a constitutional provision or statute.

(2) A power or function is in conflict with a statute if it is expressly prohibited by a statute or there is a comprehensive scheme of legislation on the same general subject embodied in the Kentucky Revised Statutes."

Federal law also supersedes state laws.

Marijuana is still a Schedule 1 narcotic under the Controlled Substances Act. State laws that have “legalized” marijuana are preempted by federal law. Certainly, states can enact laws to regulate marijuana if they do not conflict with the CSA.

But the CSA does not provide citizens a private right of action. Only the US Government can challenge the state laws. There are a number of circuits that have upheld dismissals of suits brought by private citizens challenging various state laws.

I believe AG Holder (IIRC) issued a memo under the Obama admin directing DOJ not to pursue lawsuits on these state laws.
That's what I said. States legalizing are only changing state law and thereby precluding state and local law enforcement from prosecuting. Feds are still free to do whatever they want.

But a county or city in Kentucky, by express statutory prohibition, cannot legalize something that is made illegal under state law (unless the statute includes a local option provision).

I wish there was an ignore button for posts about marijuana legalization and complaints about charges. There's 7841 pages of evidence where you all have made your case abundantly clear.

I enjoyed watching St. Peter’s play tonight. They know how to play basketball, and they have fun doing it. Now they’re on a hell of a run. Good for them.

I don’t know if either of those things are true for us? Oftentimes it looks like we do not, in fact, know how to play basketball. And I do not believe our players are having fun - at least not as much as they should be. I know if a crazed maniac was constantly screaming at me, I would not be having fun.

At this point if Duke beats Arkansas, UNC and Houston then crown the MFers. Good riddance K, F off!

That is the best 3 game stretch we have to knock that bastard off.

I hate that Duke(Banchero and Moore) as well as UNC(Manek) has players I actually like. Kansas doesn’t but they really don’t matter.

I don’t blame Cal for the TOs, missed shots or FTs. But what a missed opportunity. When he was at Memphis and they regularly won 28-30 games regular season and never lived up to the hype in March I just wrote Cal off as all hype. I didn’t like it when he came here but then he turned it around so quick. Now, and the past 6-7 years he reminds me of Cal at Memphis stacking wins but not when it counts.

Maddening.

He went to the Elight Eight 3 years in a row and the championship game in 2008. Not too bad.

Yes, Derrick Rose and before that proves my point. He also choked away a title with Derrick Rose too!

But thanks for reminding me, Gonzaga is in the boat now a days and they too have had success.
