Wow, quick to rush to judgement . Sadly , that’s what happens in DV cases . Once the finger gets pointed at the guy, guilty until proven innocent .

Police reports state facts like injuries and witness statements. Sounds like you only give the benefit of the doubt in one direction…

Based on this article, I don’t know how anybody can reach a firm conclusion about the dude’s guilt or innocence. Based on the police report, there is ample evidence to arrest. There’s a strong indication of violence. But until there’s a trial with it’s rules of evidence and procedure, or a plea, we have no idea what actually happened.

There’s a strong indication of violence. But until there’s a trial with it’s rules of evidence and procedure, or a plea, we have no idea what actually happened.

Police reports are not infallible, nor are witness statements. A trial would help determine the validity of that stuff.

I try to avoid judging people based purely off what the media reports. And, like I said, police reports and witness statements can be highly misleading.

I also don’t care about the coach, or his wife, or anybody else involved. Just not a fan of leaping to conclusions.

Same with witnesses. They can be notoriously unreliable at times.

Which is why we have trials, to sift through all the evidence, excluding that which is problematic, and presenting other evidence not necessarily provided by the police. And so we can examine witnesses and their statements.

What do we (here on the forum, or as a society in general) have to gain by prejudging the people involved?

Nothing really. But we don't have anything to gain by analyzing how much Cam Spencer should shoot or whether Paul dribbles too much either. For us that are not personally connected to the events that are happening it is just entertainment.

I would argue that, as fans of RUMBB, we are more personally connected to how the RU players perform in games than to what some guy in TX did or didn’t do in his personal life, no?

When it was one of our players, we had more of a legitimate interest. I recall when one of the RUFB receivers (Caroo maybe?) got in trouble because his GF, or ex-GF or whatever, had accused him of assaulting her outside the athletic center. It looked pretty bad with some witness statements. Everybody here was leaping to judge the kid. I was saying maybe we ought to wait and see what an investigation reveals and that we ought not judge the kid until all the facts are in.

Turned out it was apparently some other kid that did the assault and the ex-GF wanted to drop the charges and ultimately refused to testify. Eventually the case was dropped due to a lack of evidence.

We complained when TN fans and boosters started accusing Schiano of somehow being involved with the whole Sandusky mess at PSU. They had no evidence, but were leaping on the Schiano was involved bandwagon anyway.

It seems to be a characteristic of human nature for people to form metaphorical lynch mobs very rapidly. I guess, while I’m not telling others what they should do, I’m just not a personally a fan of that aspect of our nature.

I think anybody who abuses their spouse or kids or pets is a ****** excuse for a human and should get tossed in prison. I just want to be pretty certain they did it before I start judging them is all.

Nobody said they are worthless. Fallible does not mean worthless.

They can be very useful, when combined with other supporting evidence, both to the prosecution and defense.

I don't want to lynch anybody. I just think that the idea of applying criminal standards to personal opinion is odd.

If I am 51% sure some guy is a child abuser I wouldn't want him sent to jail but I also wouldn't hire him to babysit my kids. Maybe I am leaping to judgement, but so what? The world is not fair and this works in both directions i.e. giving too much benefit of the doubt to the accused harms victims of bad conduct that is difficult to prove. But this is all very meta.

They are documentation of events but are not the end all be all. What witnesses recall can change or be disputed; what is documented can be distorted, accidentally or not, by the officer; new evidence can turn up; etc.

It’s why there is a judiciary to hear the evidence & rebuttal. If the police report were infallible there would be no need to have criminal judges.

Good lord - love to know what my narrow viewpoint is as opposed to your worldly view. I’m saying you can’t discount the initial reports and a message board is an appropriate place for speculation and conjecture - I’m not on the freaking jury. I’m this case, it sounds pretty bad based on initial reports - hardly “reaching big time”.

Or most any case, not just domestic violence. The presumption of innocence and the heightened burden to prove crimes apply in the courtroom to a jury, not outside of it. Such is life. Most of us have made quick, informal judgments, even if subconsciously. Good luck fighting that battle.

Either way, eventually the facts will come out and make their way into the legal process, and then we'll see a deal or a trial. Not perfect, but it's one of the best systems we've got on this planet.

We will have to see whether Beard's lawyer is right in saying that the woman wants the charges dropped. If she does, and if the prosecutor goes along, then there will never be a trial. Complainants in cases like these often want charges dropped for a variety of reasons -- wanting the charges dropped doesn't necessarily show that she thinks the defendant did nothing wron. Often the complainant doesn't want the hassle of a trial in which she's going to be cross-examined about pretty intimate matters. His claim seems to be that he "was not the primary aggressor," but he has declined to share the audio recordings which he says prove that. He doesn't seem to be claiming that the encounter was consensual, nor denying that the woman was injured or that he caused the injuries. He might well get fired for that alone regardless of how the prosecution plays out.

Sounds like he needs to be held accountable for his actions.
But also given a chance to defend those actions by telling his side of story before punishment is given or not.
Many cases like this don't go to trial and end up being plea bargained or the alleged victim retracts accusation ,letting a violent act basically go unpunished
Other times it's found out the alleged victim attacked the accused first, then the accused used excessive force while defending themself.
Not a great excuse, but could be a reason for leniency when being held accountable for injuries inflicted.

Reasonable take. I agree, whether right or wrong, the backlash may lead Texas to pursue other options. What a mess.

This is a weird read.

What am I thinking... Thinking Beard was acting in self-defense. Not sure why he'd leave the house had he been the aggressor. The woman was capable of leaving.. but stayed and was interviewed by the cops.

Something totally embarrassing went down between them and it led to violence.. one way or the other. That's why we haven't heard what caused this from either party. They both look awful and they know it.

Wondering where teh woman is on the crazy/hot scale and if beard just made the wrong call.
