That would be my guess.I would guess the former. At his age, the fact that he's on a team, and has a girlfriend who he seems to be active with, it would be odd if he was a fall-down drunk alcoholic and it hadn't gotten out until now.
He should be kicked off the team until he completes some type of alcohol help program and then reinstated if he completes it . That video shows a serious problem , basketball should be on the back burner . The worst thing that could be done to him is to let him off with some insignificant punishment .
A number of issues are present here. Was the engine warm? Did someone see him drive in this condition? How long had this car been parked in this position? I do know the police in my county would have charged him with DUI and let the county attorney sort it out later. It would have been interesting to know what his blood alcohol level was and that would have been requested in a DUI charge unless he refused.

How in the hell is it legal to now force blood to be drawn by the police? Seems highly illegal from a constitutional standpoint not to mention unethical by the medical personnel. My grandfather was mayor of the town im originally from for 25 years. I thought he was pulling my leg when he told me it's perfectly legal and practiced state wide now.
And I'm very pro police/anti drinking and driving but I was just wondering.

I would say "f you I'm not drunk, f you i'm not taking test, and f you we're going to fight if you try and stick a needle in my arm". once they tazed me and my blood comes back clean, i'm cleaning up on suing the *****.
I know the way it was when I was in high school and college and it wasn't blood. The best thing to do was refuse the breathalyzer and try to beat it that way. Now apparently they'll take you in and have blood drawn. I guess as a way to stop people from refusing.
I just don't see how it's legal and ethical.
Not sure how other lawyers did it. But my lawyer got me off on improbable cause.
I went out to my car and started jamming to GWAR. I passed out at the wheel. Neighbor had open heart surgery. GWAR was blasting through my car so hard that the the neighbor called the police. Got arrested, but cops weren't there. Cops weren't near my car when it was started

He was charged with PI. I'm confident Cal won't throw him under the bus. I'm also confident there will be some punishment, whether we ever know about it or not. Frankly, I'm sure he's mortified by this video, and is probably already learning some lessons.

No context to determine from the video except what you see. Did he pass out getting in or getting out of the car? Was this a residential neighborhood or the highway? Did the car show signs of being on recently? It is just raw vid with no supporting background.

They can't force you to submit to a breath or blood test. You have a right to refuse. However, if you do refuse, you are looking at pretrial suspension of your license and automatic jail time- even if you end up beating the DUI charge. Blood is requested in many cases if the officer believes the person is under the influence of some kind of legal or illegal drug that will not show up on the breath test.Since I've got a lawyer here.
