Does that basically mean the judge thinks the whole thing is just a big pile of manure ?It's not wholly surprising that Dykstra was essentially found to be libel-proof. It is surprising, though, that the court did it on a motion to dismiss at the start of the litigation.

That's guesswork. What is clear, though, is that the lawyers for the publishers, which I'd guess took the lead on this motion, did a good job of convincing the judge to make a holding like this so early in the litigation. Hernandez, Backman and Dykstra were all outside the dugout loosening up by the on deck circle. Dykstra was closer than 90 feet to the dugout bat rack, but certainly other parts of the dugout were farther away. Darling said he heard him clear as a bell.The alleged comments were yelled by Dykstra from the on-deck circle as Boyd was warming up for the first pitch of game 3. Safe to assume there was a lot of crowd noise. The nearest point of the visitors dugout to the on-deck circle is about 90 feet away and the furthest is maybe 50 feet further away. So, someone in the dugout not being aware of Dykstra yelling and/or not being able to hear Dykstra wouldn’t be a surprise. Hernandez was focusing on the task at hand and corroborates that Dykstra was yelling something but couldn’t make out what it was.

In baseball, I don't believe you have to be a close knit group. Just do your job. It is very different than other sports.
