I have never seen the refs ask for acceptance or the declining of illegal procedure or illegal formation. Doesn't mean it isn't I just have never seen it.
That's why he was very careful to start his call with "the result of the play was a first down...." even though it certainly didn't seem so.

Yes. Illegal formation is a live ball penalty that can be declined by the defense if the result of the play is more advantageous, which in this case it clearly would have been had it been ruled a 4th down stop.
Why do they stop the play if there is a illegal procedure? It's not a live ball.
