In KY defendants have a right for their case to be heard by a grand jury before they’re charged with a felony in circuit court. Defendants can waive that right but that wasn’t going to happen in this case.

The Commonwealth has to obtain an indictment (or a waiver from a defendant) before starting the prosecution in the trial court. So what happened here procedurally is what happens normally in KY.

The Canadian system involves less grand jury, more cheese curds and gravy. There are pros and cons to both ways of doing things I suppose.

In the first place, the police should not be held responsible.

And secondly, if you are near someone who shoots at a police officer, and they return fire, your odds of being hit are high, especially in that scenario. Her death, while tragic, is a culmination of her choices.

Also, correct me if I misunderstood, but I thought that the AG said in his remarks that the 3 officers at the apartment were not actually the ones who requested the warrant. They were simply enlisted to execute the warrant and had no knowledge of how it was obtained, so they aren’t being investigated for that part either.

You are right, the officers involved at the apartment had nothing to do with obtaining the warrant.

The officers who presented evidence as to why a no knock warrant was necessary are under investigation, as is the evidence presented.

That’s huge because those officers had been involved for a long time trying to bust James Glover again. They absolutely had motivation to “sway” evidence and present it so it looked more persuading.

The FBI has been handling that investigation and those officers could be in trouble if wrong doing is found.

Judging by this standard, the friends, family, and loved ones of damn near every single friend I had in college “had it coming” should the police have kicked in their door, shot and killed them. Applies to quite a few posters on this thread right now, too.

I'm also of the firm belief that the war on drugs is a colossal failure.

Finally, I'd like to say that we've given way too much power and authority to our government and the police. Having too many laws on the books helps to justify our quasi police state in which shooting someone doing nothing wrong in their own apartment is even a debatable subject.

Agree with you. What happened was horrible and there will be no "justice" for her family. But to rely on the court system to provide "justice" in every case, well, that's never going to happen. You always have to look at the hard facts, detached from emotion. And in this case, from a pure criminal law perspective, it wasn't even really close as far as the two uncharged officers are concerned.

I haven’t heard/read anything on that but under KY law I’m not sure it would have been ethical to present charges against the other two based on the self defense statute.

So they hit the actual crack house at the some what same time that night and drugs were confiscated there.

This was a sting, and had they got Taylor(the person controlling the money) and Glover(the actual drug kingpin) then the operation was done!

It would have been Glover’s 3rd strike distributing large amounts of crack cocaine.

But when it comes to Breonna Taylor they can’t discuss that within the actual case because she was killed.

I may be wrong here, but that part of why Cameron constantly repeats he can only speak on what happened within the facts of THIS case.

James Glover was the target, and his right hand man was Adrian Walker(Kenneth Walker brother or cousin).

It’s a shame the police can’t just come out and present this as an overall picture and explain what and how their plan was supposed to go, before being shot at.
