But thats the whole justification here in this thread. That a journalist, acting within their first amendment right, can travel where the news is. If we venture into civil law, a person is trespassed when they are asked to leave from PRIVATE PROPERTY. Which is why no honorable judge would take this case. You have to wonder, if theres no lawful basis for this arrest. Then what is the basis? What do you think?
Lemon told his audience the protest’s purpose was to make the experience traumatic and uncomfortable for the congregants.

At the end of the day, all Maga cares about is pomp and circumstance. They are camp through and through, they love a spectacle, and all their tactics are no different than what you would see at a RuPaul's Drag race convention. This public "arresting" of Lemon is no different.

I'm not even saying this as a lib, and this will go over literally any dem or maga over 30's head, but if you ACTUALLY know what going on in popular culture and Gen Z, MAGA is as gay in their execution as any entity in the LGBTQ community

Agreed on that point. But as noted, it's a little less clear to me whether Don was there "merely" as covering, or whether he may have had more organizational responsibility. I don't think "journalism" extends to creating the events you'll cover. But as I said, I don't know the facts on that front. Similarly, I don't know if Don was arrested while "covering" the Grammys or whatever award ceremony, or whether he was arrested while "attending" them.

It raises an interesting bigger picture issue -- the fact that a cell phone has a camera on it does not make everyone a 'citizen journalist' with 24/7 1A protection every time they whip it out to film something, especially if they are involved in creating what they are filming. I'm not sure people actually appreciate that.

I guess I’m trying to say I disagree that citizens with phones aren’t citizen journalists. I agree with your distinction on being involved in creating it. Interesting topic.

Agree that it’s not always easy to differentiate. But perhaps one axis to consider is a distinction between journalism and advertising.

I like megyn kelly because she's hot, but i think saying you need an invitation to go into a church is a little bit of a stretch. Most if not all christian churches welcome anyone who wishes to attend services or come in and pray as long as the doors are open.

I’m pretty sure MK wasn’t saying he needed a handwritten invitation. She’s implying a church is private property and welcome those that come to worship and pray. If you’re there to cause trouble, um yea, you’re not invited

Completely false. There's absolutely nothing tying journalism to the need/desire for advertising (or any form of revenue generation, for that matter). This is entirely true, generally speaking ... and, in the context of the law/Constitution, if something that's 100% true could be even truer, this would be that.

No I am suggesting that advertising is along an opposite end of a pole from journalism in the 1a sense

I cannot believe that right now in the United States, we're talking about a reporter that is asking tough questions and that the government decides to arrest him. That's exactly what's happening. The same thing that happened in Venezuela.

Whats funny is watching a bunch of uninformed people says things like he trespassed. Folks, theres a lot of nuance to trespass laws, most importantly that you are only trespassed from private property if you are told to leave. Even then, you can just leave without arrest. Which he did.

Heres what the FACE act prohibits for you folks who somehow think it applies:
1) the use of physical force, threat of physical force, or physical obstruction to intentionally injure, intimidate, interfere with or attempt to injure, intimidate or interfere with any person who is obtaining an abortion, (2) the use of physical force, threat of physical force, or physical obstruction to intentionally injure, intimidate, interfere with or attempt to injure, intimidate or interfere with any person who is exercising or trying to exercise their First Amendment right of religious freedom at a place of religious worship, (3) the intentional damage or destruction of a reproductive health care facility or a place of worship.[1][2]


Now, you'd have to be extra stupid to arrest a person filming themselves, NOT doing those things with that charge. If you still want him to be prosecuted, you're just a fascist. You just want to see your perceived enemy suffer. Nothing more. You don't care about our constitution or our country. I don't even like Don Lemon... he's a turd.
