As the SEC pointed out in its brief yesterday, the Lousiana Supreme Court has held this exact same way in multiple cases, some involving the NCAA.Penalizing LSU for violating conference bylaws is a protected form of internal organizational expression & governance, rather than a defiance of the law.
The league claims it has a constitutional right not to be forced to associate its brand, logos, and championships with conduct its members have explicitly voted to condemn.
Like I said I'm no attorney & could be way off, but seems sensible to me. I can't stand LSU though so I could be looking thru biased lens.
But its Louisiana....case precedent only means what they want it to mean.
