Kupperman. The House of Representatives served him with a subpoena to testify in the impeachment inquiry. The White House sent him a letter instructing him to not testify, advising him that he would be protected by constitutional immunity. Kupperman's lawyer filed a declaratory judgment action asking a federal judge to tell him what to do (to "declare" his rights and obligations), as he is caught between conflicting orders from the Legislative Branch and the Executive Branch.
If the court accepts this request, the ruling will be very interesting in laying out the relative powers of two branches of our federal government in this context. Now that several of these unusual, but obviously important, issues are winding their way through the court system, we should begin to get some clarity on them.
