The Justice Department Office of Legal Counsel issued an opinion Wednesday supporting President Trump’s appointment of Matt Whitaker as acting attorney general.
In its opinion, the Office of Legal Counsel said that the president’s appointment of Whitaker to replace former Attorney General Jeff Sessions was consistent with the Federal Vacancies Reform Act (VRA) of 1998.

Yeah, I don’t think it’s a “win” to ignore confirmation. How long will he be “acting AG”? Why can’t Trump just send his new pick to the hill to be confirmed?

Almost like that was my point. Looks like Maryland is suing. I love how even this is now a dems thing, nevermind all the conservative legal scholars that have issues with this.

Personally, I respect the DOJ position. However, it is very dangerous. It opens the door to improper actions which could lead to a constitutional crisis. Let's hope Trump doesn't order the AG to restrict Mueller or otherwise cross a line of interference.

Trump could have ordered both Sessions and Rosenstein to restrict Mueller if he had wanted.......I think it's a little late in the investigation for Trump to give that order.

Trump's not going to order a stop to the Mueller investigate, but I would wager he wants people to think he well.

How is it a win when Trump tells the DOJ to write an "opinion" that supports his actions? That's just the DOJ's "opinion", bravo. There is at least one lawsuit pending so try to relax because nothing has been decided yet.

Why not? That does seem what most of the conservative legal scholars think would have been the right move. I for one don't have a clue and will wait for a ruling from the judiciary branch of government.

Yea, sure, put the guy who reportedly said he was going to record the President in order to invoke the 25th in as interim. Makes a ton of sense. I’m not arguing that it’s constitutionally permitted or that it isn’t. I’m merely saying Rod Rosenstein wasn’t the guy. If the argument was to have someone who’d been confirmed in the position, then he could grab 1 of 100 unknown confirmed personnel that would fit the mold. It isn’t going to be Rod Rosenstein under any circumstance. This charade is about over.

I hope just he tells Mueller to put up or shut down! If he's got any evidence of "collusion" let's hear it? Otherwise stop wasting the taxpayers's money! How long does it take to prove something everyone on the Left is convinced not only happened, but was done openly and brazenly? Sort of like stealing votes after all the election results are in?[eyeroll]
