There’s a bill in the senate that would bar transgender males from participating in women’s sports. As a father of two daughters who will probably play sports as they get older I support this.

Would this not be in direct conflict with the New Executive Order?

I’m guessing the supremacy clause would say yes but I think that’s up to the federal government to decide if they would force the state government to abide. Someone can probably answer this better than me.

It is going to be tricky. If his executive order is not challenge in court or never found unconstitutional Biden's order stands.

Hierarchy of law.

1.Constitution of the United States
2. Treaties with foreign nations.
3. Federal Executive order and administration regulations
4. State Constitution
5. State Regulations

Note: No powers can be exercised by the federal Government unless it exist in the Constitution This was explain to me in a insurance law class that, the Constitution of the United States only says what it can do. It does not say what it can't do and if it doesn't say they can do it and they do it then it is unconstitutional.

I believe it is the state of Washington, but it’s some northwestern state nonetheless, is making people use the term human milk or chest milk for midwives instead of breastmilk

In a growing number of states constitutionality is becoming a moot point. Even the Supreme Court is looking in the other direction. A few states still follow it. Most of the south anyway

I keep waiting on a very smart, rich business man, living in California, to marry his own son so when he dies everything he owns goes to his spouse (who is his son) out side of probate and no estate tax.***** I know I put the asterisk but it will happen one day.

If I am thinking of the executive order that you are referring to, does it for sure declare that a person can play in gendered sports as the gender they identfy?

I read a few articles a couple weeks ago when people were losing their minds, but haven't actually read the order.

If genetic males who identify as females are allowed to play in female sports, I do not think such a decision will end girl's/women's sports as we know it.
There won't suddenly be a bunch of Juwanna Manns hitting the hardwood and fields.
First, there are just so few people that this would apply to, women's sports isn't in danger. Second, the fear that suddenly boys will declare they identify as a different gender just to play a sport is probably a lot more fear than reality.



To be clear, and Jethro is in this thread so I'll word it simply, I do not like the idea of genetic males who identify as female playing female sports.

Most of the very smart, rich business men living in California have moved to Texas.

As the father of two girls (and you can't tell me that kids under "X" age don't know what they are / are not), I'm not completely enthralled by the idea of them sharing a locker room....regardless of what identity the he/she has. But what strikes me is the EO for he/she's to play girl sports, but where's the one for she/he's to play boy sports? Aren't we about equality? Please, DO NOT take this as me supporting any of this...just a little devil's advocate.

As far as the constitutionality of something is concerned, Cramden is correct. It's becoming a buzz word with no real consequences regarding its presence or absence. Just as we are seeing with Gina Carano right now, if you're of a certain mindset...you'll be muzzled and cancelled

It’s simple to me. If you decide to do that, you give up sports. If I decide to have surgery to give me wolverine claws I can’t participate in MMA. I think any hormone therapy would disqualify you from participating as well.

Its hard to say, but probably not. The EO forbids discrimination on the basis of sexual identity, and directs all federal agencies to develop a plan to rescind or revise any actions in conflict with that policy.

How does that effect youth sports? Unclear at this time. Are there federal agencies with the power to withhold funding on the basis of sports participation rules? If so, will those agencies decide such an action is necessary in compliance with this policy? Stay tuned....same Bat Time, same Bat Channel.

The significant thing the executive order does is signal the position the administration will take on boys playing girls sports for Title IX purposes. The Trump administration took the position that allowing boys to play girls sports was a violation of Title IX. This is pretty consistent with how Title IX has been treated in the past. Not denying girls equal educational opportunity based on their sex has meant providing them proportional opportunities in sports. That's why men's baseball is impacted by the number of girls sports.

The wokesters have very recently changed positions on the traditional interpretation, where now not only are you not required to provide a proportionate number of sports and scholarships to girls, you are actually violating Title IX if you set sports and scholarships aside for just for female students.

The federal government cannot dictate what intrastate highschool sports do with respect to having sports segregated by sex, but they can threaten to withhold title IX funding if they don't do what the Department of Education wants. There are people that are arguing that states should just take the consequences, because they think the compliance costs along with the bureaucratic red tape that comes with it basically sucks up the vast majority of the money that comes from teh federal government. That seems unlikely to me, but I would not be surprised if 50% of the funds from the feds are just spent on complying with federal mandates.

It's not surprising to me that it's you who is taking this position. If you made just a little effort to read her full comments and understand the context, even you would look in the mirror and say to yourself, "Self, what the hell was I thinking?" In any event, I doubt Gina Carano gives a damn what you think about her acting ability or her political leanings.

That's not actually what she did. That's just what idiots think she did and also people that have been misled. Lots of people mischaracterizing her retweet.

What she retweeted was overwrought. We're not going on our way to a holocaust. We are on our way to violence. We already have had some and we will probably have more and worse unless the wokeism dies down and we can get to a point where there is a concensus on the left that mainstream political thought on the right isn't deserving of a violent response and belongs in the public square. Macron has I believe denounced it and he's not exactly conservative so I think there is a decent chance a lot of lefties will realize how destructive it is before we get to real significant violence.

ETA: Also, she's not a "very average actress", or at least that's not the right way to judge her. She is an above average female action star. She's certainly not going to get any awards for her acting, but she's also generally not going to be playing roles that most actresses can play convincingly.
