In KY defendants have a right for their case to be heard by a grand jury before they’re charged with a felony in circuit court. Defendants can waive that right but that wasn’t going to happen in this case.

The Commonwealth has to obtain an indictment (or a waiver from a defendant) before starting the prosecution in the trial court. So what happened here procedurally is what happens normally in KY.

The Canadian system involves less grand jury, more cheese curds and gravy. There are pros and cons to both ways of doing things I suppose.

I get the legalities of it all... but a woman that posed no threat is dead and no one that was shooting (neither the police nor the boyfriend) are going to be held responsible. That’s not easy to digest.
I agree. I don’t think “what happened procedurally followed KY law” and “this is a terrible tragedy” are conflicting opinions.

In the first place, the police should not be held responsible.

And secondly, if you are near someone who shoots at a police officer, and they return fire, your odds of being hit are high, especially in that scenario. Her death, while tragic, is a culmination of her choices.

Also, correct me if I misunderstood, but I thought that the AG said in his remarks that the 3 officers at the apartment were not actually the ones who requested the warrant. They were simply enlisted to execute the warrant and had no knowledge of how it was obtained, so they aren’t being investigated for that part either.

You are right, the officers involved at the apartment had nothing to do with obtaining the warrant.

The officers who presented evidence as to why a no knock warrant was necessary are under investigation, as is the evidence presented.

That’s huge because those officers had been involved for a long time trying to bust James Glover again. They absolutely had motivation to “sway” evidence and present it so it looked more persuading.

The FBI has been handling that investigation and those officers could be in trouble if wrong doing is found.

Judging by this standard, the friends, family, and loved ones of damn near every single friend I had in college “had it coming” should the police have kicked in their door, shot and killed them. Applies to quite a few posters on this thread right now, too.

So I guess if you know anyone who breaks the law, watch out.

-Ate at Coles735 last night. Other than the best name, for obvious reasons, that place always delivers. Hell of an outdoor setup, which is much better than the inside I never really liked. Ben Lacy was playing so that was a treat. Shishito peppers, heirloom salad, poke chop. All nailed. It's the same old Lexington Dudley's spin off but good nonetheless.

-Indiana went full open yesterday. 100% bars, night clubs, gyms, whatever.

-Backyard looks dope AF, reaching the 1/2 way point but should be WAY better for tailgating comfort.

-Probably one of our last nights out as a team of 3 this weekend. 😰Hell of a run but ready to get this show on the road.

-Looks like an early fall this year. 60/40 next weekend.

If you can accept that, that you don’t know, you’re just making a judgment call based on provable facts...you are ahead of the game. Both sides that get that take things less personal and make sound decisions. The ones that don’t, well...

Goes for social media, too.

Trying to envision a scenario where my death isn't a culmination of my choices.

How did I miss this rule about non-grad-transfer-transfers needing more than 1 year of eligibility? Seems like that should've been common knowledge. Is it new or something?

Just notified that some in-laws will be here for the weekend (i.e. during the game Saturday 🤬). Was planning on watching solo so I could act like an *** for 3-4 hours without judgment. 6 months of pent up wildcat fan emotion will be coming out regardless.

Herro's confidence is fun to watch.

We need to end this stupid, failed and costly (both economically and in human capital) war on drugs.

-Wasn't a no-knock warrant.
-They did knock.
-These cops didn't obtain the warrant, they were brought in.
-none of Hankinsons bullets hit her.
-The fatal shot was from Cosgrove
-She wasn't in bed asleep.

I'm of the firm belief that no knock warrants should go away.

I'm also of the firm belief that the war on drugs is a colossal failure.

Finally, I'd like to say that we've given way too much power and authority to our government and the police. Having too many laws on the books helps to justify our quasi police state in which shooting someone doing nothing wrong in their own apartment is even a debatable subject.

Agree with you. What happened was horrible and there will be no "justice" for her family. But to rely on the court system to provide "justice" in every case, well, that's never going to happen. You always have to look at the hard facts, detached from emotion. And in this case, from a pure criminal law perspective, it wasn't even really close as far as the two uncharged officers are concerned.

* Trevor Bauer's performance last night truly was one for the ages. Just an absolute gem, on 3 days rest. That just doesn't happen in today's game. In the 7th, he had runners on 1st and 3rd with no outs.......then promptly struck out the next 3 batters in a row to make it thru unscathed. And it looks like he's gonna go again on Sunday, yet again on 3 days rest.

Rijo and Cueto are the 2 best Reds pitchers of my lifetime, and Bauer's 2020 season is right there with anything they've accomplished. Amazing.

* Good to hear that Indiana is opening up 100%, as New Orleans is going the opposite direction.

We just had a prominent bar shut down when video of the place during Monday's Saints game went viral. Best I can tell, they broke COVID protocols by "having fun."

* Breonna Taylor -- I think Tyler Childers nailed it. Just be a decent human being and have some empathy. Despite pieces of s*** like UKO claiming she should have made better decisions, that really could have been any of us. Incredibly sad all around.

- Few times in my life have I made a turn on a guy like I have with Jimmy Butler. Just love the way he plays. He’s always getting hustle plays on D and unlike many stars in this league, isn’t ball-dominant at all. Keeps it moving. Empowers his teammates.

And Bam - that dude does ALL the little things.

I think many thought Herro’s ceiling was Reddick but he’s got so much more to his game. A joy watching him play.

- You just knew Murray, Monk and Herro had one of those bigtime games in them in the tournament. It was coming but we never got there for any of them. One of the bigger disappointments of the Cal era.

- Man alive- we get to see our cocky, line-strong Wildcats invade the plains in just over 48 hours. LFG

- Looking at the averages up and down the Reds lineup is downright embarrassing. That said- who wants to see our staff in a series?

- Makers Cask Strength on sale along with a coupon so about $33 at Kroger. Felt like I was stealing from them. Every bit as good as the Larceny BP people hype.

- Clark - how’s the pup?

I may have missed any info on this, but I have a feeling the grand jury wasn't even presented the option of indicting the other two.

I haven’t heard/read anything on that but under KY law I’m not sure it would have been ethical to present charges against the other two based on the self defense statute.

Serve a warrant for drugs in the middle of the day?

So they hit the actual crack house at the some what same time that night and drugs were confiscated there.

This was a sting, and had they got Taylor(the person controlling the money) and Glover(the actual drug kingpin) then the operation was done!

It would have been Glover’s 3rd strike distributing large amounts of crack cocaine.

But when it comes to Breonna Taylor they can’t discuss that within the actual case because she was killed.

I may be wrong here, but that part of why Cameron constantly repeats he can only speak on what happened within the facts of THIS case.

James Glover was the target, and his right hand man was Adrian Walker(Kenneth Walker brother or cousin).

It’s a shame the police can’t just come out and present this as an overall picture and explain what and how their plan was supposed to go, before being shot at.
