It’s not a problem. At one time anyone connected to UK athletics always used the same criminal attorney if they got in trouble in Lexington. I don’t think it was a coincidence and I don’t think it constitutes an impermissible benefit.
I dont get it. Can any UK student get that lawyer pro bono?

These "exploited" athletes never pay their high priced attorneys when they get into trouble. Not at UK, not at UL, not at Duke, not at UNC, not at Kansas, not at Alabama, not at Ohio State, and not Memphis or any other NCAA prigram.

In this type of situation, it doesn’t matter if any student would receive the same assistance pro bono.

It would be extremely unwise for the NCAA to attempt to use the by-laws as a means to limit athletes’ access to counsel.

I wouldn't like you either.....if I were you.

So are you saying you do like me since you aren't me?

hey jerk-off, he ASKED a question...go provide your own proof to the own question
All I did was ask a question...

This is not some anonymous message board. This is Rupp F'n Rafters. We get more action than Wilt Chamberlain at the Bunny Ranch.
Uhhh, It's still an anonymous message board. A majority of the people here have no idea who each other are. Hence the anonymous part.

LOL!!! Sure sure. Penny pissed on the NCAAs face. Not likely to forget that. Dunno whether you can read or not, but corruption has been rampant with the shoe money. It’s kinda news. U6 was hiring under age hookers. It’s kinda news. Zion was on the take. It’s kinda news. Penny paid a recruit. It’s kinda news.

You should read the news. Not knowing is eating you up inside.
How would not knowing something in the first place eat someone up? That's illogical.

Where is your evidence Zion was on the take?

Hiring hookers is a crime. Unless in Vegas. Providing sex to minors is also a crime. Where is it against the law to donate money to a family?

The shoe company ordeal was also a violation of federal law. And nothing has even happened regarding those schools yet. Most of the players involved were reinstated, as were most coaches.
I am not sure how you rationally equate criminal activity with giving a family you know well a few grand to move.

If you are watching the news, you might want to find someone who can explain it to you.

I don’t have any evidence. I’m asking a hypothetical. Just giving an example how he is either actually paying (doubtful given he took money to move) or getting a benefit of a free lawyer bc he plays for Memphis. Ie impermissible benefit
A free lawyer isn't an impermissible benefit if anyone else has the same access, which they do. You do realize Memphis has a law school which offers a pro bono law clinic, right?

Against the law? You really are new to this. We’re talking rules of the NCAA and member institution compliance. There is no constitutional right to compete. You are not ready for this argument. Woefully ignorant.

Very possibly. However, just helping 1 other would be sufficient to prove that. Not to mention all student would not have to have the same access the the same attorney, just access to free legal counsel in general.

No one is arguing it wasn't a violation. It was a violation. What is being argued is that he will be ruled eligible this year. How are you so confused by this?

The NCAA won't be able to win in court is the point. They know this. If Memphis takes this to court they will win, rendering the NCAA powerless and eventually nonexistent. NCAA will essentially make a deal with Memphis that he sits some games, donates the same amount of money to a charity. Thus, Memphis gets what they want and he plays, and the NCAA get to appear to maintain a level of power and enforcement abilities. Everyone getting excited or expecting otherwise are setting themselves up for dissapointment.

Lose on what grounds? You gotta be a typical Memphis moron. The resemblance to a U6 crack head is amazing. Penny gave the kid’s family money. Penny was a booster. Penny the coach recruited the kid. Basically the Memphis season is a dead stick. What you lack wisdom to understand is that it doesn’t matter whether the law forces Memphis to play this cheater. The NCAA is poised to destroy Memphis basketball itself. Your season is dead. Your post season will never have happened. It’s over. You lack the intellect to know this. We laughed at U6. We will laugh at you saps as well.

Lol @ you thinking I am a Memphis fan. That just further proves your subjective to the reality of the situation. I am seeing this from an objective and legal stand point. I could not care less what happens at Memphis or U6 or any of the other countless programs your feeble mind will try to link me with to attempt rationalize your subjective incoherence. I'm just not eat up with him not picking UK because I believe Memphis won't win or make the F4 with or without Wiseman.

"Penny gave the kid’s family money. Penny was a booster. Penny the coach recruited the kid." All of this is true and no one is disputing it. It also wont mean squat in the end. Will Wade was caught paying players, they still played except for a couple of games and he is still coaching. Same with Miller, AZ and their players. Same with self, KU and their players. Same with several orther school, coaches and players.

Again, Wiseman will sit a few games and payback the money to charity. You are going to be severely dissapointed if you are honestly expecting otherwise.

Memphis and Wiseman wouldn't be fighting so hard if they did not beleive they can win. The NCAA would not be saying "may be ineligible" if they were confident in their ruling and chances at it upholding.

I hope you will come back and admit you were wrong when it doesn't go your way.

You seem really confused. No one is arguing whether in infraction took place or not. We know it did. What is being argued is the severity of the punishment. Guilty people get favorable punishments all time, even with the NCAA. This will be the same. Don't let it eat you up so bad.

I think if you look back, we have had a few players that were guilty of infractions. Were you adamant they never play as well?

Sandy Bell, meet Memphis shill. He advocates playing known cheats at Memphis.

We do that at Kentucky?

Memphis Shill, meet Enes Kanter. Almost exactly the same conditions. Well, except the benefits were never shown to be impermissible. Not one poster here advocated the lawless cheating crap you are advocating at Memphis.

Memphis has become just another sleezy scumbag institution like The Filth, U6, Auburn, Arizona and Duke. Fans that support that crap are despicable. Like you.

Enes should have been able to play. UK should have fought it harder, ala what Memphis is doing. However, Enes did play for a pro team and made like 50 grand in all. Do you think he should have been eligible or ineligible?

Again, what law was broken here? You seems confused in the differenced in laws and NCAA rules.

You seem really ate up with Memphis and Wiseman.

Anyone can get free legal aid for any reason. They just have to find it.

I am sure she does if it is something she feels compelled to fight for like she could be a benefit to the case. I am pretty sure most Lawyers have to provide a certain amount of pro bono services annually.

No laws broken. Exactly why the courts won’t give a damn. An you shilling for Memphis like a troll won’t matter either.

As regards Enes, we didn’t play him because the NCAA said he was probably ineligible. This stands in direct contrast to the cheating scumversity of Mempiss.

I’m tired of cheating filth destroying my favorite game. Filth like your beloved Mempiss.

Really? Then why did the courts already grant an injunction and why are more and more of these cases going before the courts each year? [winking]

NCAA flat out ruled Enes ineligible. It wasn't a maybe.

How is the game being ruined for you? If Wiseman had chosen UK, would you still be under the impression he should be ineligible if Penny still helped his family move 2 years prior?

UK just beat the #1 team in the country, is currently ranked #1 and one of a few faves to win it all this year. If CBB is ruined for you after that, you must be the one who is not a real UK fan. I am enjoying the hell out of this season.

Simple, courts overstep often when an un correctable wring may be committed. You get some half *** Memphis local judge, such an injunction was easy to get.

Ah, the ad hominem. Classic choice!
It doesn’t matter what gets presented it falls on deaf ears.
I could continue the thread by pointing out (from your most recent post) just bc you can find free counsel by some doesn’t mean it’s coming from ballin, making it an impermissible benefit. But then you’ll once again act like ballin does charity work and free services for all.

Also, I don’t think lawyers have to do free work as you suggest. What happens sometimes is they are appointed cases by the court and paid as an extension of the public defenders office. (For conflict counsel, juvenile matters, and custody type work).
If you’re a plaintiff in a civil matter typically You have to fund that yourself. I have never heard of being appointed an attorney to file paperwork in a lawsuit.

Exactly! The court at least temporarily believed a wrong was committed. Judges don't just rule in favor of a sports team or player. Takes years and damn near impeccable records to earn a judge seat or be elected. They aren't going to risk it or their credibility showing favoritism to a collegiate basketball team or player.

That ruling, even temporary, is not going to send a lot of confidence to the NCAA. They will settle with Memphis and Wiseman will play after sitting some games and repaying the amount to charity.

They can, it is just unlikely and they have far more to lose than Memphis if it doesn't go their way. NCAA isn't a very popular organization currently and they have several congressional members very critical of them as well. I would imagine they aren't very excited about the opportunity of this ending up in court.

The NCAA doesn't operate like a court of law. They issue inquiries, it's prove you are NOT guilty to us. This isn't innocent until proven guilty. It's also cut and dry in terms of rules regarding alumni of a University and their connection to prospective recruits. This wasn't Penny helping out a family from Nashville move to Memphis, it was him doing so with an athlete that he not only used to help him in HS but also leverage into a job at his alma mater. This isn't the only thing they've done either. More will come out. BTW--if you want to do this, at least don't have a big booster flying on the private planes to recruiting events and sitting his fat *** in the front row. That pisses off the wrong people. Penny also talking his **** against UK/Cal was seen as "cute" by everyone last year. Now he's thrown shade at Duke/UNC, etc.....they'll try to break his ***.

I don't have dog in this as I like to see talented guys play, but the point I get tired of is the "innocence" of the athlete. You can't brag how smart a kid is and how he speaks fluent Mandarin Chinese, etc...and then act like he's some dumb *** who can't differentiate from right/wrong. These players know what is up..and they get exploited as whatever they get pales in comparison to what the adults using them get, but they all become naive innocent "children" at first sign of getting caught in the recruiting filth.

Popular is irrelevant. This is law. While some county judge with obvious biases may be able to issue a temporary restraining order, I am doubtful it will stand once it goes past him. He has no basis for the restraining order. You'll see.

This problem is an unforced error and a self-inflicted wound. Penny Hardaway’s inexperience as a college coach directly brought this about.

Hardaway will claim that his financial assistance to the Wiseman family occurred before he accepted the job at Memphis, whether it actually did or not. That will not matter to the NCAA, because Hardaway already knew he would soon be Memphis’ coach. Therefore, Hardaway has to hope he can convince a judge. In the long run, I don’t think this will work either.

Having helped the family financially, I have to wonder if Hardaway used the implied obligation and the implied threat of trouble to force Wiseman’s hand and convince him to commit to Memphis. Tangled web.

Well why don't you provide is with some firsthand examples that can be verified?
You can read this if you wish. https://www.americanbar.org/groups/...me-24-number-1/rethinking_judicial_selection/

Electing judges has all sorts of issues with it and like all politicians, they want to keep their seat. Locally, all one needs to be a state court judge is be an attorney and a member of the Georgia Bar, practicing for 7 years and be 25 years of age. Tennessee has less requirements. Voters are almost totally apathetic as most don't know the candidates and are never affected by them.

I assume you know that Shelby County Judges are elected to those seats...and those judges are elected, largely, by Memphis University fans...and the judge who made this ruling is up for re-election inside a year...

You ever see the movie Miracle on 34th Street, where the political fixer tells the judge he better figure out a way to rule that Santa Claus is real? Consider this a "Santa Claus" ruling, of temporary relevance.
:joy: Yea, sure man......We are comparing the situation to a movie about Santa now? :joy:

Maybe you can even cite some specific instances with corruption or accusations in the Shelby County Judge system or particularly against Shelby County Chancery Court judge Jim Kyle? At this point you are just making baseless accusations to discredit a group or person you disagree with. Comes across like the democrats and the whole impeachment saga. You got any actual proof?

:joy: Yea, sure man......We are comparing the situation to a movie about Santa now? :joy:

Sure bud! Keep telling yourself that....maybe you'll even eventually believe it yourself.

I think an article from the American Bar Association describing just what I said would be enough for most people who expect to be taken seriously.

You posted an article about the possible negative conequences of judical elections. I don't recall saying it was impossible, but highly unlikely. Your article even points out it is not common.

Again, do you have any actual instances you can cite to support your argument? How about with TN judges? How about in Shelby County, TN? How about with Judge Jim Kyle? Surely there is some basis off which you are making these claims? Otherwise you are just slandering a judge to fit your narrative in hopes something will stick. Sounds an awful lot like another entity I know that will be starting public hearings tomorrow trying to fit a narrative against someone they don't like either.

@MdWIldcat55 used a good analogy he assumed you were smart enough to follow. Apparently he failed in his attempt.
Yea, who would have thought a christmas movie about Santa wouldn't be a good reference point for a real wold ordeal? :joy:
