In this type of situation, it doesn’t matter if any student would receive the same assistance pro bono.
It would be extremely unwise for the NCAA to attempt to use the by-laws as a means to limit athletes’ access to counsel.

The shoe company ordeal was also a violation of federal law. And nothing has even happened regarding those schools yet. Most of the players involved were reinstated, as were most coaches.
I am not sure how you rationally equate criminal activity with giving a family you know well a few grand to move.

A free lawyer isn't an impermissible benefit if anyone else has the same access, which they do. You do realize Memphis has a law school which offers a pro bono law clinic, right?

The NCAA won't be able to win in court is the point. They know this. If Memphis takes this to court they will win, rendering the NCAA powerless and eventually nonexistent. NCAA will essentially make a deal with Memphis that he sits some games, donates the same amount of money to a charity. Thus, Memphis gets what they want and he plays, and the NCAA get to appear to maintain a level of power and enforcement abilities. Everyone getting excited or expecting otherwise are setting themselves up for dissapointment.

Again, Wiseman will sit a few games and payback the money to charity. You are going to be severely dissapointed if you are honestly expecting otherwise.
Memphis and Wiseman wouldn't be fighting so hard if they did not beleive they can win. The NCAA would not be saying "may be ineligible" if they were confident in their ruling and chances at it upholding.

I think if you look back, we have had a few players that were guilty of infractions. Were you adamant they never play as well?

He has access to attorney for criminal matters. Not everyone is appointed free legal representation for civil matters he is filing under. He is the plaintiff not the defendant.
I’m asking Does mr ballin provide free legal counsel for motions filed by him and his law office for all students and citizens not just Memphis athletes?
Anyone can get free legal aid for any reason. They just have to find it.
I am sure she does if it is something she feels compelled to fight for like she could be a benefit to the case. I am pretty sure most Lawyers have to provide a certain amount of pro bono services annually.

UK just beat the #1 team in the country, is currently ranked #1 and one of a few faves to win it all this year. If CBB is ruined for you after that, you must be the one who is not a real UK fan. I am enjoying the hell out of this season.
Simple, courts overstep often when an un correctable wring may be committed. You get some half *** Memphis local judge, such an injunction was easy to get.

I could continue the thread by pointing out (from your most recent post) just bc you can find free counsel by some doesn’t mean it’s coming from ballin, making it an impermissible benefit. But then you’ll once again act like ballin does charity work and free services for all.
Also, I don’t think lawyers have to do free work as you suggest. What happens sometimes is they are appointed cases by the court and paid as an extension of the public defenders office. (For conflict counsel, juvenile matters, and custody type work).
If you’re a plaintiff in a civil matter typically You have to fund that yourself. I have never heard of being appointed an attorney to file paperwork in a lawsuit.

They can, it is just unlikely and they have far more to lose than Memphis if it doesn't go their way. NCAA isn't a very popular organization currently and they have several congressional members very critical of them as well. I would imagine they aren't very excited about the opportunity of this ending up in court.
The NCAA doesn't operate like a court of law. They issue inquiries, it's prove you are NOT guilty to us. This isn't innocent until proven guilty. It's also cut and dry in terms of rules regarding alumni of a University and their connection to prospective recruits. This wasn't Penny helping out a family from Nashville move to Memphis, it was him doing so with an athlete that he not only used to help him in HS but also leverage into a job at his alma mater. This isn't the only thing they've done either. More will come out. BTW--if you want to do this, at least don't have a big booster flying on the private planes to recruiting events and sitting his fat *** in the front row. That pisses off the wrong people. Penny also talking his **** against UK/Cal was seen as "cute" by everyone last year. Now he's thrown shade at Duke/UNC, etc.....they'll try to break his ***.

You can't brag how smart a kid is and how he speaks fluent Mandarin Chinese, etc...and then act like he's some dumb *** who can't differentiate from right/wrong. These players know what is up..and they get exploited as whatever they get pales in comparison to what the adults using them get, but they all become naive innocent "children" at first sign of getting caught in the recruiting filth.

Popular is irrelevant. This is law. While some county judge with obvious biases may be able to issue a temporary restraining order, I am doubtful it will stand once it goes past him. He has no basis for the restraining order. You'll see.

This problem is an unforced error and a self-inflicted wound. Penny Hardaway’s inexperience as a college coach directly brought this about.
Hardaway will claim that his financial assistance to the Wiseman family occurred before he accepted the job at Memphis, whether it actually did or not. That will not matter to the NCAA, because Hardaway already knew he would soon be Memphis’ coach. Therefore, Hardaway has to hope he can convince a judge. In the long run, I don’t think this will work either.

Electing judges has all sorts of issues with it and like all politicians, they want to keep their seat. Locally, all one needs to be a state court judge is be an attorney and a member of the Georgia Bar, practicing for 7 years and be 25 years of age. Tennessee has less requirements. Voters are almost totally apathetic as most don't know the candidates and are never affected by them.

Again, do you have any actual instances you can cite to support your argument? How about with TN judges? How about in Shelby County, TN? How about with Judge Jim Kyle? Surely there is some basis off which you are making these claims? Otherwise you are just slandering a judge to fit your narrative in hopes something will stick. Sounds an awful lot like another entity I know that will be starting public hearings tomorrow trying to fit a narrative against someone they don't like either.
