Yes it can, and often does. It is called "some evidence that was not allowed at the FBI trial for them to render a decision, the NCAA can use." Remember one small little detail, the FBI was prosecuting people who committed crimes, the school was NOT on trial. Well, flip the script, in this one, the SCHOOL (Kansas in case you did not know), is the one being investigated. So the NCAA WILL use the evidence pertaining to the university, not the shoe execs and runners. They will not be on trial, KANSAS will, so evidence damning Kansas, WILL be used.
