They could have possible gotten away with firing him before suspending him and letting him go to rehab; however, if Sark could prove that he was alcoholic before he was fired and that USC was aware of his problem then he could argue that USC terminated him with knowledge of his disability.
Since this federal law, it trumps anything in a contract. The cleanest thing for USC to have done was wait until he was done with rehab and then fire him.I'm guessing someone in the fan base wanted it done sooner.
