What exactly is sexual harassment? Not a Cuomo fan at all ...
Personally I dont thonk hitting on a chick at a wedding is sexual harrassment. Supposedly he touched her back and asked if he could kiss her.

I find that laughable. Now asking someone for a kiss is hattassment if the girl feels unconfortable?

From past training on how to prevent problems from occurring, it is essentially seen from the eyes/ears of the beholder. It can be anything that offends the person from a sexual perspective(actual unwanted advances or unwanted spoken language). From a coworker or supervisor. Either direct or indirect in the means of contact (the offended can hear something not intended for them and still be offended). One occurrence or multiple occurrences. The Human Resources and Legal personnel are required to investigate any reported issue. Supervisors are required to report to HR any problem a subordinate reports to them.

So in the workplace it is best to behave like you are speaking to a nun. Do not comment on the ladies bodies or touch them or sniff their hair. Yes Mr. Biden, that is inappropriate behavior if the lady/child says so.

As a coworker at the wedding it would be a tough case for the offended. But Cuomo would still be her boss so even in public or at a wedding, he can’t be inappropriate even outside of the office. Even if she does not communicate her discomfort effectively. The offense is from the eyes of the victim. So if he wanted to kiss her he should waited for her to request the kiss, had a witness and gotten signed consent. Otherwise, he is gambling she won’t be offended or scared to report the offense. It’s a slippery slope best not traversed.

I think the major thing to point out is that he is the governor of NY. You and me? Just pathetic losers at a party. The governor of NY? I could see it.

It's not necessarily his actions, but his status.

I also think it's amazingly dangerous and dumb to engage people who work for you in this manner. She said he opened up about his loneliness and his willingness to have a relationship with someone over the age of 22. Pathetic and dangerous. These people are looking for him to help their career and he goes there. He ethically went over the line.

Just cant understand the idea of getting offended so easy . If a person says something & the lady says no thanks & he is still persistent than I can see saying something.

having represented women in numerous sexual harassment cases, i'll take a shot at this. it is largely a subjective evaluation as there is not a definitive list (nor should there be) of what constitutes harassment. a lot of it depends on the context, rather than simply the words. what is harassment in one situation might not be harassment in another situation. sometimes a man and a woman, in the employment setting, have the type of mutual respect relationship where they can talk and joke about pretty much anything without it being harassment; if it's mutual. obviously, hands-on is over the line, regardless, in my opinion. but what constitutes over-the-line otherwise?

a female lawyer gave me a great working definition i used in my office when evaluating potential harassment claims. she said that when "harass" becomes two words, that's sexual harassment.

I'm sure that is part of it, but the biggest part is that he is her boss. If its outside the workplace the bar for sexual harassment is much higher. If its in the workplace...especially if the person claiming harassment is your subordinate, the bar is MUCH lower. The thought is that you aren't just asking, because you have control over their job. The person being asked can't just say no if they feel their job is at stake.

Of course, even if you aren't someone's boss you can't just ask them to blow you in your office.

I'm pretty sure sexual harassment is when a high school kid who could become a judge boofs at a party where there is a least one female. Cuomo was just exercising he Italian stallion DNA. Nothing to see here...

My sister was a pipeline inspector for over 20 years...she got harassed so much, it became a running joke. I think only once did someone touch her and she slapped them in the face in front of the crew and that pretty much ended that issue. She said the guy got abused after it happened.

What you aren’t really getting is what you think does not matter here. The victim’ s perspectives are what matters.

Unless you want to change the law.

As a pipeliner I can see guys looking & some big feeling guys saying something. I dont say nothing to the ladies at work ,although many are not ladies more like good girls...
We have 2 operators that are smoking hot & fun to joke with but no one disrespects them at all .
