but you will have a hard time convincing me that all that is worth $10 million in damages. I have no idea why State or the SEC have anything to do with that. I'm surprised he didn't sue them both for allowing the guy to bring alcohol in. That's the same bulls*** as that cowbell excuse, right?

he does not have a leg to stand on in suing MSU. I'm sure he wants MSU to settle, but I would bet the university lawyers have told him to take a hike.

Even if MSU is liable, the damages are capped at 500k, and neither punitive damages nor attorneys' fees are allowable. All state agencies used to enjoy sovereign immunity, but the Tort Claims Act waived that immunity with regard to torts.

SEC rules are not law. A cowbell is not illegal. It was against the rules of the SEC to bring one to a game. The crime was where an individual used a legal item to commit acrime of assault. 10 million is a lofty amount where death does not occur.

Not entirely true.The statestill has immunityin numerous instances. I don't think this case is about damages though. It's about trying to force the SEC to ban cowbells.
