The difference between jail and prison is misdemeanor and felony. The State Prosecutor will take a look at it and if they don’t want to file felony charges they kick it back to the city or county Prosecutor. That's a two year and under stay at the county jail. If the State Prosecutor files felony charges and you get convicted you're going to be staying at a State Prison for 2+ years. If the Feds want to charge you with Federal crimes they can. For example they could charge you with a hate crime after the State is done. For the most part they usually let the local government go first. However if the crime was serious and crossed State lines or involves terrorism they could take charge at any time. If you have committed a crime you need to call a local lawyer asap. If you are thinking about committing a crime don't.

Does this help or are looking for a different answer ?

It helps, but I don't see where the state is involved. Maybe I wrong, I don't know have never been to court.

If its a felony and not a federal crime the State will bring the charges. Awaiting your trial you will be kept in a county jail. If convicted you will be moved to a state prison to serve your time. A city policeman can arrest you for a state crime. So can the sherriff. Same with State Police. If a federal agent arrest you for a state crime he is only detaining you. Then he will hand you over to the State unless your crime is a federal and state felony. Then they work it out who gets to go first. Does that help or do I need to try and clear something else up ?

Here, there's a Roanoke city jail and bad people are housed there, there's a county jail and there's a regional jail. Regional jail is a holding jail for people awaiting trial. There is supposed to be a limit on the amount of time you can stay there.

If you are going away for a long time, you are sent to a prison that has more things to take care of prisoner for the long haul.
