He was caught on tape with a gun and his brother was the store manager that facilitated it...what is the day in court going to prove? That the gun wasn't loaded so he isn't a bad kid?

Because the police don’t have magic person identification tools. They have to rely on other clues to identify a person. Typically it someone who recognizes the person and calls the police.
