I hope both are sodomized by a black guy with a 12” johnson in prison. “American History X” style.

I think most death sentence statutes require some sort of "enhancement" to trigger it. So in Mississippi committing murder during the commission of another felony is capital murder I think; maybe killing a police officer. No clue what Georgia's is but if they don't charge them with something like false imprisonment (assuming that's a felony there) or something simiilar, they might not be able to trigger the death penalty.

Depending on whether they have a witness of them actually trying to detain or threaten the victim, I hope they plea bargain for something like 15 or 20 years. The video looks bad, but it's not conclusive and you only have to get one juror. If they put on a defense of we drove up to try to talk to him and then he attacked us and that's when he got shot, that's not a ludicrous defense. They are (presumably) allowed to have a gun and as ridiculous as it is, if they didn't point it at him or verbally or physically threaten him, they might convince a juror that they aren't guilty of murder. Since somebody took the time to video it, I'm guessing they did something bad enough that the video taker witnessed that could discredit that defense. But if they don't have that and they somehow get a mistrial, it's going to be bad.

I hesitated to watch that video but finally did. They hunted that man down and killed him. One of them was in the back of the truck like he was on a damn safari. Hope they rot and the DA that didn’t charge them for 2 months because they worked together should be disbarred at least

If you have any questions about this case... just watch the video. It's clear as day.

What about the guy who took the video? Has he been charged also?
Was anyone else with him?

Doesn't feel like cap murder. Feels like murder 2. Either way, it's a death sentence, though. They won't last 2 years in a state prison.

I haven't been following this, but I have some questions after watching the video. So, these guys must have gone up ahead of him and were waiting? Also, who filmed the video? This person appears to have know something was getting ready to go down. And whomever it is, pulled up and stopped and continued filming the whole thing w/out any apparent fear of getting hung up in whatever was going down.

I haven't seen or desire to see the video. I'm simply saying if they're guilty kill them.

There must have been a good bit of criminal mischief going on in that neighborhood. Don't tell me that was George Zimmerman on the camera.

Yea, death penalty might be a better result for them if inmates on death row are protected from each other. Otherwise, I think if I were them I would start my gender transitioning now and fight for women's prison. They may not make it there either, but might have a shot.

“As a general rule, members of the public are not legally required to intervene when they witness a crime, nor must they report it to the police. In some situations, depending on the specifics of state law, they may make a citizens’ arrest, but that is an option, not a requirement. The reason for not requiring intervention or reporting is to leave policing to the professionals and to avoid turning all citizens into informants.”

Holy crap, that happened two months ago? Maybe I’ve been living under a rock, but I just started really seeing stories about it this week, so I just assumed that it was something that happened over the weekend.

That is insane, and I still don’t understand that explanation regarding the lack of arrest at all. The claim is that they’ve been working all this time to ensure that a burglary did not in fact actually occur. So let’s pretend for a minute that it was a burglary.... Jumping in a truck, hunting him down, and ultimately murdering him is alright in Georgia?

This was in February. Pretty much nothing was shut down then.

That's one reason people are so enraged over this - these guys wouldn't have been arrested if this video wasn't released and all this went viral. They hunted this guy down and shot him 10 weeks ago, and nothing happened to them till now.

There is no hate crime statute in Georgia. One of only 4 states lacking one. I'm quite certain these flesh wrapped turds qualify. Perhaps this incident will spur legislators to make it a priority. If they can make time from trying to pass a Confederate Day of Remembrance.

Waycross PD was in charge of the "investigation" and they were...uh...otherwise engaged. Actually started complaining when a local "rabble rouser" - their words - started raising hell about it. The GBI was asked to be brought in. Not sure by whom. Maybe by the governor. Really don't know. But the GBI was brought in and literally had them shackled in 36 hours. After 2 months. 2. Months.

I just can’t imagine getting to the point they were. Let’s set the stage. You have been robbed. You decide not to call the police, then you and your dad load your shotguns and chase down random people in your neighborhood and stop them for questioning. How do you even get to that point?

Unfortunately, many police departments have a protect your own mentality that comes ahead of the law. Trivial example: politician haircuts. Guarantee their(mayor, guvna, etc.) barber shop/salon is getting a pass on staying closed. They are being told to just limit traffic so it doesn't look too bad. That's minor, but it is indicative of a double standard that walks its way up to more serious offenses when unchecked...

The hate crime statutes are stupid, but even if one was in place, it probably shouldn't apply, unless they are making up claim about the burglary.

It appears the guy that filmed it was involved in the chase as well. His lawyer is said to have released the video. After the police department asked GBI to investigate the release you know cause that’s the real issue to them is how this got out.
Believe said filmer saw the writing on the wall and is trying to cut a deal

If? There is video evidence. They claimed self defense against an unarmed man who was just jogging through the neighborhood.
I don't think it's that simple. Which is why this thing has taken so long to come to light. Remember, George Zimmerman got off for the exact same thing. Do you have a link to the full video?

I think its probably a combination of fear and adrenaline mixed with a healthy dose of racism and a warped view of justice.

Yeah, that seems like the cocktail mix for something as senseless and disgusting as this.

Out of curiosity, does anybody think they'd stop for someone that said they wanted to talk to them while holding a shotgun? Obviously who knows what decision would be in the heat of the moment, but I think my instinct would be to run away from the road and hope to get away from their truck, not try to attack a guy with a gun, but I'm pretty sure I wouldn't stop and talk to them.

I get the original DA's argument that they were allowed to open carry a shotgun and that didn't justify the victim "attacking". Certainly if they had tried to stop him and just had a holstered gun and he attacked, and the gun was then pulled out, whatever ****** decisions were made by the father and son up to that point, you don't get to attack people just because they have a gun if they don't threaten you. But if you are holding a shotgun in two hands across your body (not sure if that's' what the guy was doing) instead of with one hand pointed at the ground or pointed in the air while on your shoulder, it's hard for that to not be threatening when you flag somebody down. It'd be somewhat threatening regardless, but if you are holding in two hands like you're ready to use it that's basically a threat to use it.

That's another crazy part of this. Local law enforcement asking the GBI to investigate the release of the video, because it's obviously so damning.

Didn't it take the GBI all of 24-48 hours of reviewing the case to make an arrest?

getting out of your truck carrying a gun to confront a person while somebody is standing in the bed of your truck also carrying a gun seems pretty threatening.

That's leaving out a few relevant facts. It's still pretty simple even with the relevant facts in this situation, but your formulation would lead to incorrect results in a lot of situations.
