"You tell them EVERYONE you have been near for more than 5 minutes for the last 2 weeks." This is impossible; impractical at best.

I'm done w/ "watching" any news, no way I'll turn on the tv to watch it again, ever. I will selectively read articles to get some info but I'm done w/ FOX, CNN, ABC, CBS, all of them. I'll get my weather w/ an app, and my sports from selected outlets but as far as sitting down and watching the news (local, national, or world) I'm done and hope they ALL go out of business.

I've actually been doing this for a few years.

Lawsuits over the flu aren't prevalent because we've never had a stay at home order issued like what we're seeing here.

And aGAIN, an ambulance chaser doesn't need burden of proof to pursue litigation. His goal in most cases is to get a quick payday through settlement. He has nothing to lose, but the business has to pay to fight the case, or to settle the case, and that is a cost that the business will have to pay whether the suit is frivolous or not.

This isn't a right vs. left issue. This is a right vs. wrong issue.

Cases that have no merit will be dismissed. Cases that are seen as having merit will proceed.
Some may glance at the superficial facts of a case and see a ambulance chaser and big payday for the client, but often times once the situation is actually explained, opinions change.
This has been shown time and again thru the last 30 years.

As for the ambulance chaser having nothing to lose, if they work on contingency(which many personal injury do in the three states i am familiar with), then they do have something to lose. Taking bad cases isn't a quick way to get rich.

Something so difficult to prove such as 'I got the virus from this location and nowhere else' is a very high burden of proof. The victim basically must only visit that one place and nowhere else...at all.

Once again, I just don't see this hypothetical, where some lawsuirs are filed for catching the covid, as destroying the world(which was claimed and I originally disagreed with).

Not if you have been on Quarantine for the past month.

Now if acted like a moron that doesn't know what a germ is, Yeah, it might be hard...

But you asked "how rsting is possible" It counts on people not being idiots...

I have only about 10 people that fit that description since March.

"Now if acted like a moron that doesn't know what a germ is, Yeah, it might be hard..."

I would venture that 95% of people 60 years or less have been out and about and there is NO WAY ANY OF THEM have a list of everybody they have been around. You could make this work with prisoners in a jail but otherwise, its a fairy tale. I work in an "essential" government job and we have been working every day in our office. I drive the MSU campus daily and there are people all over the place. WalMart is full of people, Lowes is full, Kroger is full, auto parts stores are full, garages/auto shops are full. I've been in all of these stores and seen NOBODY making a list, keep dreaming. These aren't "morons" or "idiots" as you referred to us as, they are people that either work or get fired.

You think 95% of people, with it common knowledge that those without symptoms can pass on a dangerous virus that has shut down the word economy, has spent 5 minutes following people around in stores?

The part you miss is spending "5 minutes with someone within 6 feet". It's not " I walked by jimbob on the street.

It's " I saw jimbob and we talked for 10 minutes about how stupid it was to wear a mask."

Are you following people around at for 5 minutes within 6 feet at Walmart? Kroger? Lowes? If so, you might have other problems in addition to being an idiot....

You work at an office. List the people there. Home. Etc.

Otherwise, Stop acting like a idiot.

Jesus.

People like you is why we had to shut down the country.

****** moron.

Yea, that's not how our legal system works unfortunately. But ignoring that, I am guessing these will be workers' comp claims if they are filed by employees against employers. Not sure you can claim it's not a work injury or illness and use that to get around statutory immunity for employers paying for workers comp insurance. So there will probably be a good bit of litigation and appellate proceedings on that issue out of the gate.

The liability for businesses is probably going to come from customers, at least for the expenses of a ton of litigation. Still going to be extremely hard for plaintiff's to prove, but if they go in walmart and claim Walmart didn't take reasonable and prudent measures to keep customers from coming iwthin 6 feet of each other or failed to follow CDC guidance in a certain instance (which will undoubtedly happen b/c their employees will occasionally pull their mask down or get to close or whatever), then walmart will have to defend that. Could get shut down quickly by the courts, but there will be some plaintiff's bar friendly judges that will introduce some uncertainty. Line up enough clients, and it will be expensive.

Your employer cannot force you to go to work. You have a choice. You can decide that you don't like your employer's policies and quit at any time. If your employer re-opens they are simply offering their employees an opportunity to work and earn a living. Same as always. That's why I can't understand how an employer would have any liability.

They can fire you for not reporting into work.

Re : At-Will employment
Re: Right To Work laws

And you can sue for " an unsafe work conditions" per OSHA, but being in a "at-will" employment State means you'll get fired...

My feelings exactly. Physician. Wife nursing director at large hospital. We both feel same way. Test me today and I am negative. Great. Antibody test pos. Great. But if both negative it doesn’t say a dang thing about tomorrow! So unless going to rapid test me every day it is worthless to me!!
