Why cant he hold them in contempt?
The NCAA is a private organization. Schools become members on a voluntarily basis and agree to abide by the rules and policies established by the NCAA. The courts have no jurisdiction over the NCAA unless it is a matter of discrimination based on race, sex, religion, national origin, etc.

Again same deal. What's he going to hold them in contempt for? And who exactly would he do that with? Penny? The AD, school president? No one has done anything that can be cited for contempt.
I dont agree with you at all. Both UM and the NCAA are parties to a suit in his court. He has issued a temporary restraining order, he would be within his rights to issue a civil contempt of court order on either if they violated his order. You are simply wrong on this.

That isnt true. If it were, the O'Bannon case wouldn't have us where we are today. You need to read up on lawsuits vs the NCAA more.

You can take them to court for what? They are a private organization and the members voluntarily joined and agreed to abide by their rules. The courts have no jurisdiction in this case.
Jerry Tarkanian took them to court.

Academic fraud requires the school to admit it. The NCAA cant act unilaterally on that, dumb as that is.

I wonder if the injunction is a warning shot over the bow of the NCAA,signaling that Memphis isn't going to sit quietly for this to be Derrick Rose 2.0?

Penny isn't a booster and wasn't labeled as one. He donated once to Memphis and Cal has donated to UK as well. He was also not Memphis' coach when he moved Wiseman's family

It all makes me laugh. Can't wait for the day when DJ Jeffries transfers after Penny is fired.

That thread is absurd. He also spins this as some racist motivation. Penny knew what he was doing was a violation regardless of whether he was the coach at Memphis or not. In fact what he did should’ve disqualified him from even coaching Wiseman at the high school level. The point is to eliminate an unfair advantage. The NCAA makes a ton of questionable decisions but this is completely by the book. Penny didn’t do this without benefit to himself. Cal and company spent a ton of time and resources to recruit Wiseman and so did other schools. At a minimum Penny should’ve had to remove himself and Memphis from recruiting Wiseman once he got the job.

Imagine arguing that a guy that donates millions to the school and ends up as your head coach was NOT a booster (and thus allowed to pay high school basketball players) with a straight face. Just imagine being that stupid.

A former player at that.

So if John Wall donates to UK, gives a kid money to buy shoes because his family is poor--and the kid comes to UK when Wall becomes an assistant coach here--we gonna get the all ok? Hell no.

Obannon case was a Civil case about Money. Not about Eligibility to play NCAA basketball. Huge difference.
