I don't think any. Looks original. Unless someone has be capable of trademarking "the dude", but I'm not sure that's possible.

Not sure. IP law is ridiculously grey. That said, what bothers me most is that State puts more effort into stopping creative merch from being sold than creating and selling it.

I don’t see why this would violate any IP, but as far as them not being “creative”, it’s the same reason they want the M state banner used everywhere. Branding.

You don’t create multiple logos and designs when branding. You TRY and come up with a good logo and brand it and stick to it.

When’s the last time coke, McDonald’s, etc, etc significantly changed their logo? They may have different looks on cans or merchandise but the logo sticks out and is the center piece of everything.

Lot of people probably like your shirt Bc it’s creative but doesn’t really fit the brand brand the university is after.

I’d definitely do this. And if they sent me a letter id respond with wanting to see the exact IP I was violating.

Copyright that bro. Also it depends on how strict Universal is with the Big Lebowski imagery. So that's the risk the University probably avoided.

What IP is this violating?

Possibly whoever owns the merchandising rights to big Lebowski? Just looking at it, I would think the only argument MSU would have would be if it was marketed to MSU fans specifically, because it wouldn’t trigger somebody to think of MSU just looking at it. But that’s just applying common sense, not the law.

How do you claim to trademark “State”?

I looked into trying to get licensed to make and sell trademarked State stuff a couple years ago. Turns out, it’s a real pain. You have to have insurance, pay a fee, submit “examples” of your product, and then pay a hefty %. State required a higher % than most other schools. So, when you see a licensed product from a maker at a retail shop, it’s got 40-50% tacked onto what the maker gets, not counting his insurance and expenses.

And yet there is so much burgundy garbage being produced and sold legally.

I guess they gave up on trying to sell everyone on "The Outfield Terrace" term when they were trying to clean up the outfield image?

This is the type of thing that drives me crazy about this stuff. So MSU, Dudy Noble Field, Davis Wade… I get it. That’s university created stuff, and it’s fully understandable as to why they’d own those rights.

But State, the Dude, PTLGD? Seriously, how does one get to swoop in and trademark something that they didn’t even create in the first place? Is this how it works? First person to file gets the trademark no matter who came up with it?
