Lawsuit update?

Just asking. Is there any update on the status of the former football players lawsuit? If I remember correctly, it was due to hit the courts in March.

No reason? It still looms pretty heavy over the entire program. Maybe ties down BF until he gets resolution. Probably still being used negatively by others during recruiting. I think we all need resolution.

If news doesn't break on this matter for some other reason, it is scheduled for May for trial.

Of course, a judge ruling could change the need, as well.

I doubt they're going to trial in May. I anticipate all of the defendants will file motions for summary judgment. That's where a party alleges there are no issues of material fact in controversy that would allow a reasonable finder of fact, i.e. jury, to find in the non-moving party's favor. Basically, you win without having to go to trial.

I haven't heard that anyone has filed for summary judgment, but I also didn't check PACER. My educated guess is they've completed written discovery but haven't finished depositions due to the football season.

There was a post on TOS a week or two ago from a poster who claimed to know some people who have knowledge of the behind-the-scenes activity concerning the lawsuit. The poster says there is a mutual effort by both sides to quietly reach a settlement. I have no idea if this is actually true or not.

What do you think we are telling our prospective recruits? It seems to be a non-issue in recruiting based on the mix in skin colors in the incoming classes.

Settling before trial will have negative implications and while not outwardly as bad as going to trial and losing, there will be some fallout. In the media, there will be a portrayal to some degree as an admission of guilt on Iowa's behalf. That could potentially cost Brian Ferentz and Seth Wallace their jobs. It could easily open the doors for others of the past to want to file suit too.

There's just not a way you can pay a settlement, big or small, to the plaintiffs to avoid trial yet say "but with this said there is no wrong doing involved". Too many people and the media will portray their own take on things.

Cant imagine that Kirk would go along with anything that reflects poorly on his program and on Brian in particular. Also, if one of the settlement demands is the release of Brian by the university then again, a settlement is out of the question.

This is where I said earlier this is where there could be a rub between Kirk and UIs attorneys if the attorneys just want to "settle" in the best interests of the university. I agree with your assessment completely here.

Three things. After all this time, the attorneys on both sides have a feeling which way a trial will go. Iowa has a history of settling out of court. When a defendant does this, they are trying to cut their losses. The last thing. Coach does not tell attorneys what to do. He is a defendants, answer questions, provide information, the attorneys make the decisions.
