but when did the Senate decide what is and is not unconstitutional? Seems like there's another branch of gov't that does that.

I guess, when the Chief Justice bailed and the Supreme Court declined any involvement.

Judges are supposed to be impartial, no way leaky Leahy is impartial. In fact, he's one of the more crooked senators there is.
