Are worker safety and protection laws the topic of discussion here. I’m pretty sure he was referring to lawsuits regarding COVID. Not sure how an employer can protect someone from a virus.

Why aren’t they filing lawsuits against China? China released the virus either intentionally or on accident.

I think most families that lose loved ones to Covid in a LTC facility has a legit case. Funny how athletes in a closed environment don't catch it and are tested daily but we can't do the same for the elderly.

Yes, especially in New York and New Jersey when the infected residents were brought back in, knowingly infected. For suits in general during a pandemic, I'd think negligence would have to be proven.

I am wondering when all of the small businesses are gonna group together and sue their respective states. All of them ordered closed while Walmart , Home Depot and the liquor stores allowed to stay open. Picking winners and losers and financially destroying people

Actually, yes.

There were laws, guidances, orders etc placed on businesses (I am a business owner as well and have had to stay up to date and adjust constantly). If businesses did not follow those, then they were not follow worker safety and protection laws.

Opening this door concerns me though for sure. Because even though we, as a company, have followed all of the guidances; it doesnt mean I might not have to spend a fortune defending us at some point.

You gotta wonder if someone wins a lawsuit against a business for COVID, what is to stop that from translating to someone suing over the flu or even a common cold.

My companies HQ is in one of NorthEast quarantine States...all,the corporate folks are holed up in their homes, can’t travel...etc. But by damned the sales force better be out there pressing the flesh, making sales calls, getting new business.

Im pressured into trying to secure meetings etc. with people that aren’t really comfortable doing so. And my VP seems perplexed as to why it’s so difficult...he is a bit of a truther.

Does kind of irk me a bit.

Not a well thought out comparison. A job role that directly exposes you to dangers introduced by the employer is way different that catching a virus that can be caught anywhere you are among others. If you are afraid and don't want to work, don't work. Don't ask that every other employee of the company suffer, as well as ownership, because you are deathly afraid. COVID is real deal and scary, but masking and distancing should be the mitigation, not shutting down.

For better or worse, Desoto not withstanding, we are not an agrarian country, therefore we have to work jobs that provide currency to trade for food, in lieu of starving. If we could each just grow our own food, have our own wells, etc. then we would not have to interact with others.

They don't have to group together. Anybody that sells anything any big box store was allowed to sell should be able to sue the government entity that shut them down. Sucks b/c taxpayers shouldn't be on the hook for that, but if they had any type of license to be open, that's a property interest the government took away by shutting them down, and the government shouldn't be able to argue police power or health and safety when it probably made things worse by concentrating shopping at the big box stores.

Yup. THere is a reason infectious disease typically isn't covered by WOrkers comp laws. I think there has been legislation to cover COVID under workers comp for healthcare workers? And that's probably a good idea.

Otherwise, I'm not sure workers have (or should have) any remedy.

Provides sweeping and all-encompassing protections against suit for private businesses and healthcare providers, state and local governments, school districts, non-profits, etc. Applies retroactively to March 14 and extends protection against suits for one year from the date that the wuhan emergency is lifted (whenever that occurs).[FONT=&quot]

Kinda. But the Robert Fosters of the world are going to run into issues claiming protection under Section 3:

SECTION 3. (1) A person, or agent of that person, who attempts in good faith to follow applicable public health guidance shall be immune from suit for civil damages for any injuries or death resulting from or related to actual or alleged exposure or potential exposure to COVID-19 in the course of or through the performance or provision of its functions or services.

Most states will not allow you to sue them. Which is why Texas Tech still owes Coach Leach a pile of money.

You sound like someone who's never worked in a mill, mine, construction site, or factory. He's talking about the ridiculous liabilities employers face these days. The pendulum has swung to the other extreme in this country. It's insane.

Regardless of what any group, union or company says, safety is never the top priority, nor should it be. Nothing, and I mean nothing would ever be accomplished if safety was actually the No. 1 priority.

"Safety first" is an interesting topic. Your turn.
