-Regardless it was a dumb move and if you watch the show before this season she's very lucky she didn't go home. Probably because they didn't have the heart to send her home while at her alma mater.

-Losing House sucks, it was bound to happen, surprised he didn't get mentioned for any openings earlier in the process. Stoops has made good hires, he's a defensive guy, and we'll be fine. All part of having a realy impressive season. Very impressive to have NFL teams coming after your coaches. Wondering if he promotes from within or goes out and grabs someone.

-KU, this is all a looooooooong time coming and I'm going to enjoy it as much as UL. F*ck those pompous asshats.

-IU. Lolz. Fact Mack is winning with his group and Archie is losing with a top 10 draft pick and an AA caliber leader is all you need to know. In a much easier league as well. Don't be silly, Keion.

BBN having an antagonistic relationship with our HOF coach’s family is a great idea.

Don’t pin this on BBN.

When Cal makes $10 million a year, then puts his completely undeserving son on the bench as a walk on, then on scholarship, then redshirts him to squeeze one more free year out of the school, this is what happens. To every coach’s kid ever.

But particularly one who has that tattoo and brings extra attention on himself by dressing like a fool.

And to top it all off, he’s got two more children instigating and antagonizing all comers on the www at every turn, knowing damn well what the outcome will be.


This is like a case study of how NOT to act when it’s well known you’ll be scrutinized in the public eye 24/7.

Euro Randoms:

-Great trip across the pond, as always. First time to Ireland, and we really enjoyed. Maybe b/c it was low season, but I found Dublin rather quaint and charming. Hit all the classic pubs, and even made some new friends. Favorite Pub was O'Donahues, which was right across from our hotel. No actual live music or stage, but a place where locals/patrons sometimes bring instruments and bust into tunes at their table providing music for the bar -- that's exactly what happened both nights we visited, was really neat.

Didn't have time to get West, so we rode the DART down the coast, ending in Bray, where we hiked up to the Head. Never done much hiking, but it was a pretty fun time. The trail, as PTI(pti) would say, was pretty 'technical'. Wife was a little scared, and I was only focusing on not injuring myself & ruining the rest of the trip. The views from the Top were incredible.

Our Hotel, The Merrion, was one of the most unique/cool I've ever stayed in. #1 in all of Ireland on TA, and was warranted. Definitely recommend for anyone visiting Dublin. Definitely want to get back to check out the rest of the country at some point, the people there were the best we've ever come across.

-London was fantastic, I absolutely worship. To me, it's basically NYC in Europe when it comes to food, theater, nightlife, shopping, and endless things to do - only w/ all the extra English tradition, which is what really makes it special. Spent 3 hours in the Tower of London, that place has an insane backstory -- and of course saw the Crown Jewels.

-Stayed at the Rosewood. First time at one of their properties -- if I were a Schembari, that would be my hotel chain choice. A little out of our league, but we really enjoyed. Great location on the edge of Covent Garden, right beside the Holborn Tube. I'm a Subway honk, and London's is just so damn easy & efficient...blows NYC out of the water in that regard.

We both agreed it was probably the most fun of our 4 trips over there, and not necessarily b/c of where we were, or what we did -- instead of being turbo tourist bouncing from site to site, we really had zero plans & went with the goal to slow down & relax, for once. Tried (and failed) to see something important every day, but really just treated it like a normal relaxing vacation & soaked in the Vibe...eating, drinking, wandering, ftw.

Favorite thing? Borrough Market -- what a place. The markets are typically my favorite thing in any town, but that one is definitely my favorite...much more open & less hectic than most.

Europe is just awesome.

-It really sucks not being able to access the Catpaw over there, though. :angry:

They finally indicted the driver responsible for the Marco Shemwell accident.

Reckless homicide (Class D felony - 1 to 5 years) and being under 21 and driving with a BAC of at least .02 (Class B misdemeanor).

Is there a lot of pre-natal field medics in the military? Because this guy in my office said he used to specialize in that and I find that a little interesting.

Also, claim is he didn't swerve, which would mean the kid was either in or really close to the street.

If pregnant you are considered nondeployable. If you get deployed and they find out you're pregnant you get sent home. Which ends up becoming kind of a big deal because we can tell by BHCG levels and ultrasound how old the fetus is, and lets just say that Jesus is the only immaculate conception I've heard of in the desert. So if she's been in country for 12 weeks, but the fetus is only 6 weeks old, the stories don't add up.

Adultery in the military will get you a court martial.

Not a lawball either, but since the underage limit is either 0.00 or .02, intoxication does not need to be proven. Just being over the limit is considered evidence. That is for a DUI arrest, so I assume that then rolls over into the reckless homicide charge. I.e. since he's underage, they don't have to prove that he was impaired, just that he was over the limit.

And pre-natal doctors transitioning to a career of throwing bricks through windows and asking the foreman if they get to keep any leftover copper wire from the job site sounds totally legit.

If the case goes to trial, the prosecutor will want to have an expert testify about those BAC results. Defense likely will too. Age, weight, tolerance, etc. All factors in play. Accident reconstructionist necessary also.

Obviously, this is going to be a very fact-specific case. What was his BAC? Was he actually "under the influence" at that BAC (may need expert witness testimony)? Did he actually swerve for no reason like the witness above stated?

A person shall not operate or be in physical control of a motor vehicle anywhere in this state:
(f) Having an alcohol concentration of 0.02 or more as measured by a scientifically reliable test or tests of a sample of the person's breath or blood taken within two (2) hours of cessation of operation or physical control of a motor vehicle, if the person is under the age of twenty-one (21).
Ky. Rev. Stat. Ann. § 189A.010 (West)

In any prosecution for a violation of subsection (1)(b) or (e) (does not apply in this case) of this section in which the defendant is charged with having operated or been in physical control of a motor vehicle while under the influence of alcohol, the alcohol concentration in the defendant's blood as determined at the time of making analysis of his blood or breath shall give rise to the following presumptions:
(a) If there was an alcohol concentration of less than 0.05 based upon the definition of alcohol concentration in KRS 189A.005, it shall be presumed that the defendant was not under the influence of alcohol; and
(b) If there was an alcohol concentration of 0.05 or greater but less than 0.08 based upon the definition of alcohol concentration in KRS 189A.005, that fact shall not constitute a presumption that the defendant either was or was not under the influence of alcohol, but that fact may be considered, together with other competent evidence, in determining the guilt or innocence of the defendant.

The kiddie DUI statute doesn't seem to make the same presumptions regarding intoxication as adult DUIs, unless the kid is over a .08. Assuming this guy isn't over a .08, I think they have to prove he was under the influence and/or reckless by using more than a BAC that is under .08 (which may be pretty easy here with officer testimony).

Basically, there's nothing in the DUI statute that presumes a kid is actually intoxicated if his BAC is less than .08...he's just not legally allowed to drive if it is .02 or more. He's only presumed intoxicated if he blows .08 or higher.

Now, of course, they can prove his intoxication in other ways, but just blowing over .02 and under .08 isn't going to get them all the way to a reckless homicide conviction, IMO. There will need to be more (which there very well may be)


(insert here where another CATPAW lawyer comes along and shows me how I'm wrong, wouldn't be the first time)

Lexington police Sgt. Stephen Yoder said at the time that Heil’s vehicle might have “veered off the road a little bit,” before striking Marco, but Spedding, said “all the information we have is that he did not” veer off the road.


This is what I was referring to. I actually walked up on the accident, about 45 minutes later, and his car was all the way in the front yard and across the sidewalk. So initially, I think, people assumed he swerved. However, it sounds like the swerve was after the accident.
