I don't see that happening. That particular plea deal was way outside of the typical plea agreement. I have never had an AUSA differ to a state prosecutor once an indictment was unsealed. Typically, it goes the other way. If a guy is charged in state court and the Feds indict for the same conduct, the state typically dismisses and let the Feds whack the accused. Sometimes, that actually ends up working out better for the accused, but rarely, and never like the Epstein plea, in my experience.

The laws he was charged with were never (and shouldn’t be) intended to apply to a fact pattern such as Mo’s fact pattern. This includes (1) obtaining underage photos while a minor himself in a situation where hundreds of kids received the photo and (2) the only publication involved here was to the girl in the vids.

Hundreds of kids didn't send the video to the girl. To the best of my knowledge, hundreds of kids also followed the school principal's request to delete the video from their phones.

"Mo's" fact pattern is filled with continual patterns of doing the wrong thing. Sometimes that **** catches up to you. Simply put, delete the message as requested when he was in high school, then he doesn't have the child porn on his phone when he was an adult, and he doesn't send the video when he is pissed when she thwarts his advances.

Life is simple when you do the right thing. You don't have to hide behind subjective interpretations of a law.
