Detained by cops last night (False accusations)

I'm walking down the subway steps to get on the train to go home when two cops say "hey you against the wall".. Keep in mind, I'm a bank manager...I have a suit and tie on and I have a bag full of stuff from desk. So at first, I'm thinking "well maybe they think I have drugs" (I'm a young black male, I don't play the race card but it is what it is). BUT the cops walk me upstairs and say "I'm accused of assaulting a man".. It's some guy bleeding from his head but this is what FVKS me up, a "eyewitness" states "he knows for sure it was me".. He pointing at me and everything..it would be one thing if he said "He kind of resembles him or he looks similar".. He straight up said " I saw him assault this man".. So now the West Philly in me comes out and I start snapping.. I'm cussing main man tf out...Now the eyewitness all of a sudden has to leave...Naw, you gonna sit ya *** against the wall until we get this straightened out.. .It's a Philly subway at 8pm and I have a suit and tie on, how the hell you get me confused with anybody?????.. The thing that saved me was when the cops initially stopped me I was on the phone.. I showed the cops I was on the phone for 40mins, how could I assault him? Why would I assault him, I never seen the victim a day in my life.. Eventually I was let go but is it anyway I can press charges or file a complaint about false accusations?? The cops have everyone's info

What did the suit look like? If it was some of that Cam Newtonesque stuff, i could see where you made the dudes eyeballs bleed.

Re: a claim. It’s unlikely. You’d have to prove that you suffered some form of injury (financial, emotional, physical) as a result of anybody’s actions. And you’d have to demonstrate some tort was realistic. I don’t think there is a case to do that here unless anybody was unduly physical.
The “witness” is a dick but probably did not end up committing a crime (lucky for him) since in the end you were let go, with what seems like not a lot of delay.

you can file a complaint against the cops but again, I don’t see anything they did wrong here

For a baseline to start I am a white guy that has always lived the rural life

My trips to as they say the big city had some similar things go down

Sorry that you are feeling it was racially driven and that is possible and I want to be in the front of the line saying I wish the situation had NOT made you feel that way

More than likely the people involved were dim witted half or full crazy people that would say anything even if a lie

It is a shame it happened to you regardless of the reason but in todays world decent people have to be very careful as they can get drawn into a mess without any reason

My advice is thank the Lord that is was cleared up and use this as a life experience to avoid getting into the same situation again even though it was not your fault

More innocent people are hurt such as yourself by lied and misinformation from people with bias and an agenda

Again sorry you had to deal with it but calm collect and be cool under fire was the best choice

That sounds kinda traumatizing to be honest, and I would be pretty angry as well. Really sorry you had to go through that

It’s not illegal to make false accusations unless you can prove that this person made the false accusation on purpose. Think it would be a civil case but not sure.

What a ****** day! Glad you ended up ok. Good thinking on the cell phone call.

Please file a complaint against the officers involved. If this was a one time screw up, then nothing will happen. However, a history needs to be established if mistakes continue to be made.

I truly am sorry it happened to you.

I would file a complaint.

I was told by the law enforcement officer that I have the most respect for, that his job was to investigate crimes and arrest people, and it was the judicial system's job to determine if they were guilty or innocent. That law enforcement officer was Chief Reuben Greenberg.

Chief Greenberg was a black man of Jewish faith.

The only thing I'm worried about is.. everyone was recording the situation and I was snapping on the eyewitness using foul language...lets just say "ninja, I will f u up" lol... I dont think it will go viral but due to my position, it could be a issue

It won’t go viral. Thousands of people curse at others on public streets daily and it doesn’t go viral unless it escalates to violence to someone is nekkid. Were you nekkid?

Sorry this happened to you. Could it be a situation where the “eyewitness” knew the man that was beaten and it was all a scam to get free money from you in court. You know you were in a suit and tie and would be an easy score. Just a thought. Again. Sorry you had to go thru this.

Im sorry you had to go thru that! Nothing can be done for the cops detaining you. They were doing their job and ultimately got it right and released you.

Now, I would hire an attorney and start the process of determining who the eye witness is and what the actual perp looked like so that i am ready to roll if that vid goes viral and affects your job.

Could this have been a setup between the witness and “victim” where they saw a nicely dressed person they could shakedown for $$? I guess you will be on your phone in the subway every time now.

Glad everything worked out for you OP. I’m surprised the cops even stopped you as awful as they are up here. My buddy got hit on his bike 2 days ago in a hit and run. It happened right by a SEPTA bus which has cameras on it. My buddy asked the cops if they could pull the footage from the camera to help figure out who did it. They straight up told him no that wasn’t their responsibility and his lawyer had to do it. They’re awful up here

As a retired banker, just let your boss now what happened, that you said a few curse words, and they should be very understanding of the situation you were put into and how you reacted. I don’t see it being a professional issue at all As long as you don’t go off on some chronic NSFer wanting their overdraft fees reversed 😁

Damn man sorry to hear about that glad you are okay could’ve been way worse but still sucks either way.
I was detained once in college with one of my friends and while 2 cops are talking to us and clearly have us caught some ******* walks up and says “those are the two guys right there. I saw them those are the guys.” Which I guess he did see what happened but that still pissed me off. I wanted to beat that guys *** so bad. Like clearly the cops have us. Why would you come up and say that. Luckily it was a minor incident and we were let go and just had to pay a little fine but man I would’ve spent a week in jail if I could’ve gotten my hands on that kid who walked up to the cops while they clearly had us in custody.

Eyewitnesses are nearly useless. Humans are really bad at identifying strangers, especially when they were stressed, and especially when the stranger was a different race.

Heard the same thing about EYE witnesses all my life

My daughter lawyer and others in law enforcement say the best thing is hard forensic stuff

Glad this was resolved. The problem was the "WITNESS", not the police. They were doing their job. We need to get over this crap about police. Sure, they're human, but they are all we have between a fairly normal society and CHAOS. The good book says lawlessness will increase, so we will need them even more, until the Lord Himself, comes!

What happened to the guy that was assaulted? What was his version of events? Did the cops detain you based solely on the eyewitness statement?

Wow that sucks. Why would somebody do that? Maybe just trying to shake you down somehow? I doubt you can do anything legally because the person can just say the y were mistaken and didn’t do anything intentionally malicious.

That really sucks and I empathize with you, but assuming everyone was sincere (witness really believed it was you, cops behaved appropriately, etc) I think there’s no blame anywhere. I absolutely understand your feelings but sounds like it played out reasonably.

he has already noted that the cops did nothing wrong, it was the accuser that screwed him over
OP is correct. Police had to act on probable cause based upon eyewitness testimony. As already noted, eyewitness testimony generally needs corroboration because it is not fully reliable. Police let OP go when they had a reason - 40 minutes of consecutive phone conversation.

Did the assault victim AND the eyewitness both pin this on you? Keep in mind that Jessie Smollett was convicted for filing a false charge. If there is fault, then it is on the civilian side.

Man I’m sorry to hear this. When I was 9 and my brother was 15 we were walking down the street and a cop drove by, pulled a quick u turn, and eventually put us in the back of his car because we matched description of kids who had robbed someone’s home. The kicker was he took us directly to the guys house for the guy to ID us and never tried to contact our parents/guardians. The victim originally falsely ID’d us and my brother raised seven kinds of hell to the point the guy finally agreed it wasn’t us. Cop eventually released us and drove us home (where we were originally heading). Our parents went apeshit and eventually had the chief of police and the cop at our home. Later that year we received two letters - a formal apology from the office and a later one saying officer had been relieved of his duties. It definitely has stayed with me to this day and the way I view police.
