My knowledge of the protect college sports bill is what I’ve heard here and what he said today, but it sounds good to me. A lot of success seems based on enforcement but it seems like the correct approach. I have studied sports economics, TV contracting, game theory in sports, etc in past coursework (mostly intro level but it was real study and application). I think I’d be in favor of it without that, but what I learned in that work really reinforced my support.

5 years to play 5 seasons.
Hard cap at 24 years old.

Nil has to be true nil. (No under the table payments to attend a school)

all that sounds good, BUT......, maybe I need a civics refresher..... but how do they enforce these rules?
Isn't there already case law saying the players aren't limited on any these proposed rules?

It all came from antitrust initially saying the NCAA can’t enforce certain things because they are a monopoly. The LAW would give the NCAA limited immunity to enforce these rules as I understand it. A judge would have to rule the law is unconstitutional which would open up an even larger can of worms.

Then a judge could rule that roster limits hurt players. Targeting penalties suspensions? Oops, that hurts my client . You can go down a huge rabbit hole here if there isn’t a law passed.

The laws passed to protect the other professional sports have worked pretty well and they are able to enforce their rules.

Is it alright to dislike Cruz & the woke crowd in Austin?

Texas ain't trending purple, but instead the Republicans are nominating horrible statewide candidates. Texas is a 55-45 Republican state where even Ted Cruz can get 51-52% of the statewide vote. Paxton is a worse candidate than Cruz and could very well lose. If Cornyn had won the primary, he would be leading in the polls by 2-3 points. Trump has only himself to blame if the Republicans lose the Senate.

The only antitrust exemption the professional sports leagues have relate to TV broadcasting rights. The teams are able to pool their rights into single contracts.

The pro leagues address labor issues through collective bargaining, which is what college sports needs. Give the athletes a voice in how their sports are run.

In a weird legal twist, a court opinion over 100 years ago held the antitrust laws do not apply to MLB. But in the 70s, Congress passed a new act enforcing antitrust law on MLB labor issues, so they collectively bargain now, too.

You make the penalties so severe schools and cigar boys aren't willing to risk it. First offense paying a player under the table is a three year death penalty and the entire coaching staff gets a 5 year show cause. Second offense is a 5 year death penalty, 10 year show cause, and the AD gets a 5 year show cause.

If it passes as a law in congress, couldn't the feds then enforce it?

I don't think its ever going to pass. If it looks like it might pass, there are some huge holes to fix or else we are just setting up more litigation.

They could enforce it, but how? It's not a criminal statute, and there are no stated penalties for non compliance.

Enforcement is left to an agency created by the schools, which is currently the CSC. There is a constitutional question of whether Congress can leave enforcement of a federal statute to a private entity.

I guess. The FBI works prostitution under "human trafficking" all the time. The irs works evasion of assessment and payment and money laundering..... if you had a 18 year old receive 500k to choose... some school.... I guess it may fit under human trafficking and money laundering. Or if the kid doesn't declare the income, evasion of assessment.

But the federal alphabet agencies have a lot on their plate currently. .... and good luck getting an under staffed U.S. Attorney's office to prosecute such a case.

Admit I know next to nothing on regulating athletics. All I know is I see the Clippers and related parties getting hammered by the NBA for the Kawhi Leonard salary cap skirting. The Feds are joining in on the criminal side as well.

That said there must be some sort of end state that allows an actual enforceable rules structure. Might have to call college sports (at least some of it) what it is (a pro sports league) and maybe something in the antitrust exemption world has to happen. Regardless of the how and what the "something" is - it feels like it should possible bc we are seeing it play out in the NBA world right now.

So under the table payments like we had before NIL? At least most schools can compete above board now unlike most of the SEC previously.

What did he say about her? All I remember is him retweeting a pic that made her look less than attractive. And no, I'm not defending Trump. If you whittled down politicians you support to only those with morals, integrity and the sole desire to better our nation, then you would eliminate the professional political class. Oh wait, that would actually be pretty awesome. PquV.gif
