3 DUI convictions is a felony. it does not necessarily mean automatic jail time, but your more likely to go to jail on a DUI felony than most other felony charges. They don't tend to offer probation and such like they do with first time felony offenses for other Crimes. Mainly because the judge will see that you just aren't going to stop breaking that law. So they will typically make you do some sort of jail time. This law keeps people safe as well and the judge can get a lot of **** for not locking someone up if they kill someone.
