A different question about the flag

Why wouldn’t step 1 be to stop the manufacture and sales of the state flag? Seems obvious, but you can’t fly one if you can’t buy one

Whoa! I don't think anyone (or at least very few) would advocate outlawing manufacture and sale of the flag to anyone who wants to fly it. As much as I hate that flag, I would be strongly opposed to that. It wouldn't survive a court challenge anyway.

What legal grounds would you use to stop a private business from selling a flag to a person that wants to fly it at their private residence or business? That's some North Korea level rules there.

If you rationally think about this entire situation, and that's your "step 1", I'm scared to ask what your steps 2 and 3 would be.

What do you do about the thousands that individuals already own? Imminent Domain? The flying it isn’t the issue anyway as neither school flies it, it’s just the fact that it’s the official state flag.

Not necessarily. It could be as simple as a copyright or trademark. Does any state have something like that for their flag or anything that could be considered state branding? If that kind of thing exists, you can have some level of control over who produces items that carry your copyright/trademark. And if you can stop people from producing them, then obviously others can't then sell them.

Those are just some theoretical questions, though. I have no idea of the law around that kind of thing. And it obviously does nothing to stop Billy Earl from flying a state flag he already owns.

You have the right to fly whatever flag you want to fly, however divisive symbols should not be endorsed by the state.

Perhaps instead of not allowing the manufacture of it, pressure should just be placed on businesses to not sell it.

This is what happened with the battle flag a few years ago when Walmart and others proudly announced they would no longer sell it...that proud announcement was due to public pressure.

At this point, that racist store in Branson and other minor players are who seem to sell it in b&m stores.

There's this little thing called the First Amendment. What you are suggesting would be the government targeting speech because of its content, which is a major no-no. And, yes, flying the flag of your choice is speech. Hell, dancing in a strip joint is speech.
