UL is a voluntary member of the NCAA and has agreed be subject to the rules, decisions and penalties of its governing body. Whether the NCAA rulings were fair or unfair is not a constitutional issue.

I've been as critical of Pitino as anyone, but damned if he ain't right about this: Not everyone is aware of the somewhat obscure 69th Amendment, passed in secret in the mid-1990s after a bi-partisan meeting between Bill Clinton and Newt Gingrich:
