So I say” you will be one of Biden’s strongest supporters when he runs for President again” as if that is a possibility. It isn’t!!

The Biden administration did nothing to secure the border and allowed over 10 million illegal aliens into the country. And now that it’s time to remove them, we don’t have enough judges or court rooms to listen to all of these people‘s cases.

People who should’ve never been here to begin with. People who have caused American taxpayers hundreds of billions of dollars. People who have committed crimes, who have overwhelmed school systems and housing markets.

I don’t for one second believe that our constitution prohibits the president of the United States from removing these illegal aliens that were purposefully allowed to invade this country under the last administration.

Nobody, not even the Supreme Court can make determinations about national security.

To allow this would mean that our immigration laws are meaningless.

I hear a lot of people are throwing around the words “due process” without knowing what they actually mean. So I did the research (also listened to Mark Levin who did a really good job explaining it):

1. Illegal Aliens are entitled to notice and a hearing before an immigration judge.

2. They can pay for their own attorney and present evidence.

3. They have the right to appeal the decision of the immigration judge before an Immigration Review Board.

4. Appeals to federal district court may happen if:

A. Final order of removal
B. Constitutional claims
C. Legal errors
D. Convention against torture
E. Writ of Habeas Corpus

5. Limited review in district court means:

A. The court cannot second guess the underlying evidence.
B. Cannot review discretionary decisions.
C. Cannot review factual findings.
D. Maybe barred from reviewing expedited removal orders.

Kilmer Abrego Garcia

- Appeared before an immigration judge to contest his removal from the United States in 2019. During this hearing, he presented substantial evidence, including personal testimony and documentation, asserting that he would face persecution if returned to El Salvador.

- The immigration judge determined that he was eligible for removal.

- He only married his girlfriend while he was detained, not for the three years prior to his arrest.

- He appealed, the Immigration Appeals Board allowed him to stay because being sent back would endanger his life due to rival gangs.

Only 26% of immigration decisions are appealed to the federal court (according to statistics from 2021-2023). Reversal rates are only 1-7%.

Garcia had notice and a hearing. There was a paperwork error otherwise the administration would have gone to immigration court and had the order stopping the deportation removed because the rival gang no longer exists.

His due process rights were never violated.

This is a paperwork error.

A President has the power to let 10 million people enter our country illegally. He can even put them on planes and fly them to any city he wants.

But when a President tries to remove people who are here illegally, the courts jump in to stop him. What a joke.

Currently. There are about 11.7 million undocumented immigrants in the U.S. right now, per DHS and Pew. That’s lower than the peak in 2007.

From 2021 to mid-2024, 10.1 million encounters were recorded at the border. Not 10 million people—encounters. That includes the same person getting caught multiple times.

Of those, about 2.5 million were released into the U.S. with notices to appear.

Roughly 2.8 million were removed or expelled.
-Net increase in the undocumented population under Biden? Just about 800,000.

So if you’ve got any data showing 20–30 million were let in, drop it. I’ll read it. I’m willing to be wrong. But if you can’t back it up, ask yourself—why are you repeating lies from people who don’t even respect you enough to tell you the truth?

The Supreme Court has jurisdiction over foreigners only when they are in the country lawfully.

The Constitution does not apply to enemy combatants on American soil, illegal immigrants, or to foreigners in their home countries.

Moreover, deportation is not a punishment. Foreigners have no right to appeal their removal to their home countries to American courts. Just a fundamental misunderstanding by the entire legal profession about what citizenship means.

In full transparency this was the issue I had with illegal immigration all along. I don’t understand how nothing was done during the last administration. How were no judges watching what was happening and stopped that? It makes no sense and it could lead to less trust in the judicial system as it could be seen as partisan. How do you allow an administration to create a massive, illegal, unlawful problem then completely hamstring the next administration? How is there no repercussions for Mayorkas and Biden? If this is our policy why wouldn’t every immigrant in the world come here? We have created a huge problem. Seems like they should be held responsible. Ackman makes a reasonable point here:
