Texas Judge has spoken. SEC cannot punish teams who sign former NFL players. Is Simmons, Jones, and Sweat available?

The rule has nothing to do with players. The coaches and the schools get the punishment. The schools also voted for it
Good point, punishment is most financial to the schools and their employees (like coaches) but nothing about players or forfeited games or anything. So not sure what it means to say "SEC cannot punish teams".

I am not a lawyer, but it seems like someone could make the argument that the threat of punishment by the conferences keeps the players from being able to play and amounts to interference / restraint of trade. With that said, I would love to see the conferences tell this judge to go eat a **** burger.

Couldn't that same argument apply to the 5 year limit? That's an arbitrary number. You're stopping somebody from making millions of dollars just because they have already played for 5 years. People can go to college for many more than 5 years to get multiple doctorates. Basically the NCAA can't make any rules.

I agree. Its amazing to me that no player has sued to play in spite of the 5 year limit. It seems like the next battle.

Right. Why is it legal to restrict to 5 years, but it's not legal to ban former pros? I think this judge's legal reasoning may be open to challenge.

Exactly, if the other SEC teams refuse to play teams with former NFL players is this judge going to force those teams onto the football field somehow? LSU choosing a bad hill to die on for a 2nd string TE.
Simple thing is this.... If LSU does not want to go by the rules of the SEC office, they can leave the SEC. Simple as that. Or the SEC could force a forfeit for every single game that player is on the roster in SEC play. Sideline, starting, backup, whatever. If that player is on the team, forfeit. The SEC can absolutely take that approach, along with suspending the coach and fining the school.

The Baton Rouge judge just entered a similar order. The SEC and Sankey were added as defendants in that case (and a few other cases). The hearing on the Restraining Order has been moved from Monday, to Thursday September 3. That is 2 days before the season starts.

I wonder what kind of discussions are going on at LSU? I still think they will stand down like Texas Tech did, but they may have to put Kiffin in a straight jacket first.

Will the point that the teams are not forced to be members of the conference and can play by the rules or leave ever come up ?

It absolutely will come up...except that the teams can't just leave. There are contractual obligations. However, the teams voluntarily joined the conference and agreed to be bound by its rules. Even new rules, that everyone just voted in favor of.

I don't know if that is enough of a "Freedom of Association" argument to carry the day. Tom Mars says it is. The judges want these guys to be put in the same position as if they had never left, so I don't know.

What I'm tired about hearing is that things are a "constitutional right" - the LA attorney used that phrase when arguing for the players.

I hope Lane does indeed play one of these NFL rejects. It will be interesting to see if the Conference does put the hammer to them. I would love to see Sankey sit Lane for a while.

Its the players suing the conference, not LSU. But Kiffin talked them into it. The B1G has a rule that could be used to punish Lane just for that, but the SEC doesn't. The NCAA has a rule it could use.

This is the truth. We are supposed to have 3 co-equal branches of government to keep everyone in line. The executive, no matter the president, and the judiciary do what the hell they want. Congress can't do anything except go on vacation.

Who told you our government branches were co-equal? They are not. They are set out in the Constitution in order of importance. Congress - the voice of the people and the states is by far the most powerful, they just aren't exercising their strength. Congress has the power to fire members of the other two branches, and has the final say in almost everything. And if the Constitution prevents Congress from doing something, they can initiate the Amendment process.

ETA: Ross added the same stuff i said below lower in his thread. It wasn't there when I first saw the tweet, or post, or whatever we call them now.

I think what Ross is missing here is the SEC and NCAA are still fighting these rulings. The SEC should and will abide by court orders...but what if the judge withdraws his order, or a higher court rules the trial judge did not have authority to enter the order in the first place?

If LSU plays the guys in the Baton Rouge case, they will be gambling that the order is ultimately upheld.
The NCAA was the same.
NCAA is a mixed bag. Membership is technically voluntary, but at least one court has ruled as a practical matter the only way to participate in intercollegiate sports is to join.

I don't know if the NCAA plans to appeal the orders blocking its use of its rule of restitution against member schools on First Amendment grounds.
