Well let me ask you this. This is the scenario I bring up whenever this discussion occurs. And this is a true story.

Back in the day one of my buddies in law school drank too much and drove wherever. I don't think he was hammered but he was over the limit comfortably. He was the only person in his car and stopped at light. 2 cars collided on the intersecting road in front of him and one of the cars then rolled into his stopped car. No major impact but enough that he had to wait for the police. Does he deserve a DUI?

He received a DUI. Why? He was doing absolutely nothing wrong except for the illegal act that put him in that position to begin with.

Yes. He deserved it. He broke the law and was caught. No different than being stopped at a checkpoint.

If a drunk driving a car pulls over to the side of the road and passes out, should he or she get a ticket? The answer is, they do get tickets

Once you are here illegally, you are a felon. They take jobs that legal residents can do and be paid more. Illegals drive down labor costs.

So, by your own admission, he was doing something wrong, driving illegally. And yea, I think all illegals should be deported, every single one. If they can come back legally, great, but they should all be removed. I don’t care how long they’ve been here, I don’t care what services they perform, I don’t care if they have established families, if they’re illegal, see ya.

Yes, it’s heartbreaking to hear some of the stories, but, fundamentally, they created the conditions to which they should be held accountable for. Period. Don’t go where you’re not invited.

His illegal act was drinking and driving. Did he exit the car with keys in ignition? It is still a DUI. Did he have his keys on him if he exited the car? Still DUI because of proximity to the car. Just because you didn't cause the accident doesn't mean you didn't break the law.

NY state troopers tried to give me a dui for sleeping in my truck in the bar parking lot . I didn't have the keys so they lost in court .
