No organization can make rules that violate federal law. Other sports leagues generally have collectively bargained agreements that provide certain protections from antitrust challenges. The NCAA does not have that same protection, which is why its rules can be challenged under federal antitrust law.
I've never understood how an organization made up of educational institutions makes such stupid decisions. At some point, one would think that the NCAA would have seen the handwriting on the wall and assembled some good legal experts to help design an organization that has some sense of relevance and doesn't violate federal law.

Can anyone explain to me why the 5 in 5 rule should exclude the 2022 HS class? I would like to hear some kind of defense of the NCAA's position that makes sense.

I'm not gonna lie though, I smiled when I saw Trimble and Aberdeen are currently ineligible. Hope it stays that way.

Does this mean all the 2022 guys will have to play in one of the 6 protected states? Let's go get some more dudes. We can kick off a couple of the current guys for team rules violations.

This is such a ridiculous saga. At some point NCAA needs to just stop fighting this litigation and just let the dudes play and standardize everything for the season after this one.

Until collective bargaining happens for the NCAA, which will be madness across all sports I’m sure this will never be over.

I am not familiar with the intricacies of federal or state anti trust law, but this is now a state appellate court and a federal court of appeals that has overturned a trial court’s TRO in favor of the NCAA. I suspect that carries some weight when asking what the Ky Court of Appeals may do. In Colorado, the plaintiffs probably should ask for an en banc review, if the decision today was just a 3 judge panel.
That or just take it to the state Supreme Court, if they agree to hear the case which they probably would because of the outcome across the nation and college landscape.

NCAA is horrible at picking their battles. If they just would have punished UNC instead of saying that fake classes and fake grades were ok then they could have continued the "student-athlete" charade. It all fell apart then.
They should have enacted a reasonable pay structure long ago so they could at least take that to court when this all opened.

I can't keep up. Just get rid of college sports. Keep the college names. Let universities choose if they want a professional team or not.
They can rent facilities from schools.
Players can attend college, if they want to.
No sense pretending it is college athletics played by student-athletes.

Kentucky Supreme Court would not have original jurisdiction over such a matter. It has to go through the trial court and the court of appeals first, I believe.
