INTERVIEW: JOSEPH V. PATERNO

The date is 10/24/11; time 12:17 p.m., interview of coach Joseph Vincent Paterno, 830 North McKee Street, State College, PA. Scott Paterno is here representing his father. Randy Feathers is also present.

SASSANO: Coach are you aware that this statement is being taped and do you give me permission to tape this statement?

J. PATERNO: Yes.

SASSANO: Did Mike McQueary, some years ago, come to you, report to you an incident that he observed in the shower between Jerry Sandusky and another individual most likely a young boy.

J. PATERNO: Yes he did.

SASSANO: Okay, and can you tell me what Mike McQueary told you please.

J. PATERNO: Mike McQueary came and said he was in the shower and that Jerry Sandusky was in the shower with another person, a younger, how young I don t know and Mike never mentioned it, that there was some inappropriate sexual activity going on. We didn t get in to what the inappropriate action was, but it was inappropriate. And that's how I knew about it.

As detailed in my report, the e-mails and contemporary documents from 2001 show that, despite Mr. Paterno's knowledge and McQueary's observations, four of the most powerful officials at Penn State agreed not to report Sandusky's activity to public officials. As made clear in the attachments to our report, on February 25, 2001, Messrs. Spanier, Curley and Schulz agreed to report Sandusky's abuse to the Pennsylvania Department of Public Welfare. On February 27, 2001, these men agreed that reporting to DPW was not required, reasoning in the words of Graham Spanier that "[t]he only downside for us is if the message isn't 'heard' and acted upon, and we then become vulnerable for not having reported it." The only known, intervening factor between the decision made on February 25, 2001 and the agreement not to report on February 27, 2001, was Mr. Paterno's February 26th conversation with Mr. Curley regarding what to do about Sandusky. Again, this conversation was memorialized in the contemporary email, where Mr. Curley said "[a]fter giving it more thought and talking it over with Joe yesterday -- I am uncomfortable with what we agreed were the next steps."

Q: I think you used the term fondling. Is that the term that you used?

Mr. Paterno: Well, I don't know what you would call it. Obviously, he was doing something with the youngster.
It was a sexual nature. I'm not sure exactly what it was.

Q:
Other than the incident that Mike McQueary reported to you, do you know in any way, through rumor, direct knowledge or any other fashion, of any other inappropriate sexual conduct by Jerry Sandusky with young boys?

Mr. Paterno: I do not know of anything else that Jerry would be involved in of that nature, no. I do not know of it.

Which is worse of course after 1998. But again, why slow play it? Well, that's what the standard used to be.

Take your time, see if a victim surfaces, potentially intefere/intimidate the victim. This was the playbook of the Catholic Church since shortly after they were founder to the early 2000s.

I have training in mandatory reporting, if I think there is abuse in a certain situation, I reported immediately. No offense or butts I don't go to any supervisor, I don't attempt to talk to the alleged victim, I just directly reported with the information I have.

Back in 2001 Penn State had telephones and I'm sure there were people that knew what agency to call and they failed miserably. Kicking the can down the hallway does not exonerate you from your failure in immediately reporting it.

And fwiw Mike McQueary wouldn't be a mandatory reporter. Joe should've immediately called someone who had authority to report this. And he shouldn't have waited eight days to personally talk to Mike McQueary.

That would be no big deal if they decided to immediately reported, not kick the can down the road, again, and talk to the 2nd mile foundation weeks later.

It's all Joe's fault because he should have violated what's not NCAA policy and taken thing into his own hands?

Don't you find it peculiar that Dad, Dranov, Joe, Curley, and Shultz all said Mike told them something similarly vague but it was Joe's fault for not doing more?

Dranov and Dad weren't told anything actionable by MM since he was in shock about it and they couldn't do anything about it that wouldn't have brought the PSU hierarchy down on them. Joe and CSS were told more and their own WORDS show that through the emails or direct testimony from Joe. Not peculiar, just self preservation.

That's absolutely ridiculous.

You're saying that MM was in too much shock to tell dad and Dranov what he experienced? And even if he was you think tht was the last time he talked to his dad, mom, or other family members?

Dad, Dranov, Joe, Curley, and Shultz all said that MM used soft language yet somehow you believe that was true of what he said to his own family members but not true about what he told Joe Curley & Shultz. Remember MM said that Joe was great about how he handled things and supported him.

Yet that is exactly what the evidence said. Joe admitted that MM told him that he saw Sandusky doing something sexually inappropriate with a child (CSA) and Dranov said MM was so upset the night of he did not press him for info. MM said Paterno was great because Paterno protected him from the PSU admin for whistleblowing, that's why MM went to Joe in the first place. Sandusky was a popular local legend and MM reporting him would have resulted in institutional retaliation. Once Joe was fired MM got the ax but PSU had to pay him 12 million for that retaliation. I know a lot about this case.

That makes less than zero sense. You're saying that MM called the people closest to him and that he trusted the most but wasn't able to explain what he had witnessed. Not then, not ever. It was just one night and it never came up again.

You suggest that MM was able to clearly tell Joe what he experienced even though he admitted that he didn't use explicit language when talking to Joe. Furthermore Posnaski was writing a book about Paterno when this all went down. He wrote that Scott had to explain to Joe the concept of an adult man having sex with a young boy because it was too foreign to him.

Here's an interview transcript:

SASSANO: Okay, and can you tell me what Mike McQueary told you please.

J. PATERNO: Mike McQueary came and said he was in the shower and that Jerry Sandusky was in the shower with another person, a younger, how young I don’t know and Mike never mentioned it, that there was some inappropriate sexual activity going on. We didn’t get in to what the inappropriate action was, but it was inappropriate. And that’s how I knew about it.

SASSANO: So he did not elaborate to you what this sexual activity was, only that he witnessed some sexual activity between Sandusky and a young boy?

J. PATERNO: Well he, well he, to be frank with you it was a long time ago, but I think as I recall he said something about touching.

SASSANO: Touching?

J. PATERNO: Touching.. whatever you want to call them, privates, whatever it is.

SASSANO: Okay, could he have said there was something more? An actual sex act?

J. PATERNO: He never said that.

J. PATERNO: He never said that.
It makes perfect sense. MM sees a legendary coach molesting a little boy and is stunned. This is a local legend with a lot of power and influence and who has been lauded for his work with children. This is far worse than catching your spouse with your best friend. Now MM is a GA needing a job so what does he do? A previous assistant coach had seen Sandusky in action but decided to keep quiet about it to avoid institutional retaliation. He moved on to another job later on.

So, MM has a dilemma. If he's going to speak up then he will need protection from PSU and neither his Dad nor Dranov can provide that. Joe can and MM knows it as does his dad and that is exactly where they tell him to go. This allows MM to pass the buck and clear his conscience and then stay in good graces with PSU.

It works. MM stays and has a nice career at PSU for the next 10 years until Aaron Fisher comes along and blows it all up.

As to what MM told Joe? Sure he didn't use words like B*tt F*ck but he clearly told Joe it was inappropriate and SEXUAL. That was more than enough to mandate Joe to make sure the cops were informed. Joe didn't do that and participated in the decision not to report Sandusky when he spoke with Curley February 26, 2001. Joe avoided legal penalty because he passed the buck to CSS and they paid for it.

Joe knew about pedophilia as the Roman Catholic Church scandals were well established in 2011 so that is BS that he didn't know what it was.

Joe failed to live up to his carefully crafted image when it mattered most. He deserves the scorn he gets today and will forever tarnish his legacy.

Curley owes his entire professional life to Joe Paterno and PSU and was, as his friends said, loyal to a fault. We will never know the truth from him. That he is silent about it tells me it was bad or else he would speak. At the very best, Joe approved of Tim's plan not to tell the authorities and at worse he changed Tim's mind to not report Sandusky.

This is my final comment. No one knows definitively what McQueary discussed with Paterno, Curley, and Schultz. No one knows what Curley and Paterno discussed. You can speculate until your balls turn and deeper shade of midnight blue and they'd be of little more use to you than your brain is.

The juries disagree. We know what MM shared with CSS and Joe because of their own testimony. We do know what Joe and Curley discussed because the email from Curley tells us. You are in denial. That's what happens in cults of personality. Hopefully folks like me can deprogram you?

No it is not. Penn State was given a report by a licensed PhD Psychologist that said Sandusky was a likely pedophile and they buried it. CSS and Joe would have lost their jobs in 2001 because they were told about Sandusky and did nothing to mitigate or restrict him from their property.
In 1998 the DA (Ray Gricar) did not press charges. So, why would there be enough evidence to keep Sandusky off of campus but not press charges. At this point one (JoPa, CSS, etc.) should think even if charges are brought, the accused is innocent until proven guilty.
In 1998, JS was still a ln employee of PSU.

I can't believe I have to explain this but the bar to press criminal charges is a universe higher than telling and enforcing Sandusky to stay off campus with children alone. As Gov Corbett once explained, getting a pillar of the community convicted of CSA with one incident would be very difficult to do and you only get one chance. Fall short and trying to charge him again would be viewed as persecution. Gricar was also ELECTED. This cannot be emphasized enough. Going after Sandusky legally but unsuccessfully in 1998 would have got him run out of office pronto. However, PSU could have well within it's purview banned Sandicksy from bringing children on campus and showering with them alone. Also, the staff could have been alerted to look for it as well. Any responsible leader and institution would have taken such steps after the incident but they did nada. So, in 2001, their backs were against the wall and they had to cover it up.
