The Supreme Court voted 5-4 today to enshrine birthright citizenship as a constitutional right.
And Justice Clarence Thomas just torched the majority opinion to the ground.
Thomas said the court's ruling is built on a feudal English principle where "subjects owed lifetime servitude to the King who owned the soil on which they were born."
Read that again.
A principle born in medieval castles. Rejected by the American Revolution. Now apparently the law of the land.
Thomas, joined by Gorsuch, laid out the real history. For decades after ratification, the federal government consistently denied citizenship to children born here of parents not domiciled in the United States.
The rule was simple: a child born of "a stranger or traveler passing through the country, or temporarily residing here" was "not a citizen."
That was the understanding. That was the law.
Thomas made it plain: the majority's entire theory rests on the opinion of a New York assistant vice chancellor in an old inheritance dispute. Not Congress. Not the Founders. Not Constitutional text.

Thomas called out what this really is: the Fourteenth Amendment being "repurposed for political projects that the Reconstruction Congress did not support."
The five justices just rewrote American citizenship using a feudal blueprint the Founders literally fought a Revolution to escape.
Thomas closed with a warning that echoes: "Today's opinion devalues that citizenship. I respectfully dissent."
He's right.
The fight moves to Congress now. A constitutional amendment is the only path left. Trump knows it. Patriots know it.

As to serfdom, just the idiocy. Without birthright citizenship you would potentially be creating a separate class of essentially "serfs" in this country with none of the protections of citizenship. Which would continue generation after generation.
Most of us on this board could potentially be non-citizens without the protections of the 14th Amendment, which has always, ALWAYS been interpreted as conferring citizenship on almost everyone born in this country with a few enumerated exceptions (by the framers of the Amendment as well as the courts) since it was ratified.

2020. CBS NY reports on Turkish anchor baby ring busted operating in Long Island, NY — not only did their babies get US citizenship, they were getting taxpayer funded healthcare in the process.
These are the type of insane birth tourism schemes that are incentivized by birthright citizenship, and have to be stamped out:

Pregnant women from other nations hould be barred from the US until this is eventually resolved.

The issue is not just about making sure pregnant women do not get visas. The bigger issue is to make it extremely difficult to come to the USA AND THEN pin that global compliance requirement on Chief Justice John Roberts, making him live every day with the consequences of his blinded American stupidity facing him, belittling him, ridiculing him.... Make every overburdensome rule and regulation specifically attributable to John Roberts decision.
Pre-screenings, pregnancy tests, supplemental bond requirements, and much more.... No exclusions for diplomats, sports figures, actors, employees, H1Bs, the works.... Make visa entry subject to a compliance nightmare at a scale that is unheard of. And blame Roberts for it.

Moron if you were talking about the plain text of the amendment, there wouldn't have been a long majority opinion and dissent in the original decision Kim Ark decision. I read Jackson's dissent and it didn't add much. Of course, she is the moron who doesn't know what a woman is and the idiot who said that if birthright citizenship was ended that we faced depositions of mothers as to the status of children.

Birthright citizenship existed long before the Constitution was amended to address it. If they wanted to limit it to address only the children of freed slaves, they could have easily written the Amendment to state directly as such, but they didn't do so ... why?

Ever stop to notice that the people you want to pick on are always the most vulnerable? Pregnant women (Roe v. Wade, birthright citizenship, etc.), especially ones desperate enough to potentially abort their situation; poor/uneducated (taking away aid and benefits); illegals looking for asylum from horrible situations (deportation, etc.), gays/trannies.
