What's false about it?
These whackos couldn't be more wrong and make themselves look more foolish in their attempt to spin crap. Dave is worthless as you know. Don't expect a conversation that is meaningful in the least.

Uh ... no ... it has never worked like that. We have 3 branches of government for a reason. Checks and balances and all of that specifically so a president can't come in and act like an elected dictator
Who checks and balances the Judiciary aside from the appointments? Seriously, I am unclear on this.

That doesn't apply to this case and the rule itself is talking about permanent situations, not temporary.
I think that's the real issue here....Trumps vague and bold talk during the campaign + his lack of transparency in his thinking as President + his seemingly eagerness to associate this temporary ban with permanent national security = people freakin their geek

Federal judges must go through a stringent screening process and get congressional approval. The courts don't make law, they are there to make sure that the things that come out of the legislative and executive branches are lawful and constitutional. That's also why they are not elected positions, so they can make rulings without worrying about re-elections and would also be relatively immune from corruption.

This is a nice summary of all the branches and their checks over the others:
Legislative Branch

  • Checks on the Executive
    • Impeachment power (House)
    • Trial of impeachments (Senate)
    • Selection of the President (House) and Vice President (Senate) in the case of no majority of electoral votes
    • May override Presidential vetoes
    • Senate approves departmental appointments
    • Senate approves treaties and ambassadors
    • Approval of replacement Vice President
    • Power to declare war
    • Power to enact taxes and allocate funds
    • President must, from time-to-time, deliver a State of the Union address
  • Checks on the Judiciary
    • Senate approves federal judges
    • Impeachment power (House)
    • Trial of impeachments (Senate)
    • Power to initiate constitutional amendments
    • Power to set courts inferior to the Supreme Court
    • Power to set jurisdiction of courts
    • Power to alter the size of the Supreme Court
  • Checks on the Legislature - because it is bicameral, the Legislative branch has a degree of self-checking.
    • Bills must be passed by both houses of Congress
    • House must originate revenue bills
    • Neither house may adjourn for more than three days without the consent of the other house
    • All journals are to be published
Executive Branch

  • Checks on the Legislature
    • Veto power
    • Vice President is President of the Senate
    • Commander in chief of the military
    • Recess appointments
    • Emergency calling into session of one or both houses of Congress
    • May force adjournment when both houses cannot agree on adjournment
    • Compensation cannot be diminished
  • Checks on the Judiciary
    • Power to appoint judges
    • Pardon power
  • Checks on the Executive
  • Vice President and Cabinet can vote that the President is unable to discharge his duties
  • Judicial Branch
  • Checks on the Legislature
  • Judicial review
    • Seats are held on good behavior
    • Compensation cannot be diminished
  • Checks on the Executive
  • Judicial review
  • Chief Justice sits as President of the Senate during presidential impeachment

"Dangering of America"?

You are precious.

You know we already have a vetting process? You know there have been zero murders on US soil since 1975 by immigrants from the 7 Muslim-majority countries on the list?

Thanks. I'm not seeing much except for the appointments. Seems obvious that political leanings aren't enough to get an impeachment of a Justice, hence all the squabbling we do over the appointments. I reckon something criminal or an obvious lack of mental fortitude would get the ball rolling.

WTF ???? I would say we find out daily and sometimes hourly what he is thinking.
I'm not referring to his "mental twitches", I'm thinking more along the lines of strategy that involves specific goals and processes to reach desired outcomes.

I would say that we will see more specific plans as he meets with his cabinet, congress and advisors. I have said many times that taking office makes the new leader face reality. It separates the "chaff" from the seed.

If we held politicians accountable for their campaign rhetoric, we would all have got to keep our insurance and keep our doctors too. Total BS.

I'd say the biggest check of all is Congress's ability to write/change law.

Yes, it would take something extreme ... which is by design

I think it depends on the rhetoric. And I think there are plenty of people holding Obama accountable for not being able to keep their doctors....aren't there?

F that *******.
While I immediately want to agree and smoke his *** going back to about 6 years ago, now trying to figure out the mess gives me a headache. It's like shifting sands or an ant bed swarming in all directions. Short of a big gas can and a match, it's going to be hard for the rest of the western world to get this problem quelled. Any troops we send at this point are apt to get their *** shot off by weapons we've sold them or otherwise provided

edit: replaced the world with the western world.

Lol, who the **** saves posts to make a point? If we were like them and didn't understand how Americas legal system works this is where we would start screaming about activist courts and judges, but we aren't them, we are waiting until November. This has broad appeal past his base, they got a lock on the frightened old white racist vote.

Nothing activist about this activity. The ninth was the activist court, blocking the order on unfounded arguments in the first place.

I guess I don't get why this is such a big victory. How many people are really coming here from places like N Korea or Syria?

Hahahaha, if it’s not a big deal, why was there a need to challenge what was so obviously within the purview of the Executive branch and specifically the President’s responsibilities?

Man, you guys have some short memories. Syria? There was this whole refugee thing, it was kind of a discussion topic for about 2 years.

That's why we already had watch lists and NTSDB. This smelled of symbolism way more than substance. Like the wall. And Space Force.

So I’m confused, either it was a big deal to you all or it wasn’t? I mean, you fought it for a year and a half, so I’m guessing that it was. But now, ya downplay the loss? Ok, I can see the attempt at rationalization. That’s fine.

From my perspective, this was a valid EO, it was likely for show, but valid none the less. The countries identified were chosen for specific reasoning, originating from St. Barry the Feckless, and Trump was just carrying it out. Fodder for the base. You all blew it way up in your zeal to “resist”, so now, you take the loss that has greater emphasis than it should have.

My defense of it, even though I agree and actually understand WHY those countries were selected, was mainly on principle. The principle being the Constitution, and it clearly stating he has constitutional basis for executing this Travel ban. Looks like the Courts agreed with Trump and not with you all and your zealous attempt at “resisting”.
