Being Washington, he will probably get more time for that than if he had actually murdered or hit him. Especially if it’s a legal weapon. Democrats have pushed for HB1692 since 2022, it’s still in sub committee at this time. It limits punishment for game members if they commit a violent crime like drive by shootings. They can’t face life in prison if they are under 21, it would also release those already serving sentences because they are in a gang. It promotes racial equity, That’s the justification.

The bill simply limits the charge from being elevated from 1st degree murder to aggravated murder. They still get charged with murder. You do realize murder 1 can still get you life, right?

There is a BIG difference between what a murderer CAN get and he or she DOES get:

"Criminals found guilty of first degree murder face a maximum sentence of life without parole. These crimes are usually pre-meditated, though a murder that shows extreme indifference to human life also qualifies. Due to sentencing guidelines, first degree murder charges usually result in a sentence of 20-30 years, with 20 years being the minimum."

Right, that's true of any crime and sentencing guidelines, which vary from state to state.

That's literally why they are changing the law, to be able to determine the appropriate sentence based on a totality of the circumstances for each particular case.

That is where we disagree. It has nothing to do with an "appropriate sentence." Stuff like this is why we read stories of career criminals committing horrible crimes.

So give us some data on it. How many people not charged as an aggravated crime because of a driveby shooting go on to commit horrible crimes?

Right. Did someone say otherwise about the reasoning?

Was that a drive by? They seemed to be stopped and out of their vehicles when it starts. Seems like the initial tweet was irresponsible in the way they framed it.

Please provide the data that show those who are convicted of a driveby shooting and are given the lighter sentence are most likely never to commit another violent crime. Afterall, these laws are state laws so it shouldn't be that hard to find the data.

Common sense and experience tells me that a driveby shooting is both premeditated and wreckless. Innocent bystanders are often injured and/or killed. One of my last investigations before I retired from being a state cop was a 6 year old girl killed while doing homework at the kitchen table when one of these driveby shootings happened.

My last comment on this subject is simply this. Thanks for a civil discussion and as someone who has studied practical research, I can say with all honesty, "There are lies, d*** lies and statistics." Most statistics tell us more about the researcher than the facts being researched. I say that just to say that I am sure I could find statistics that support my view and you probably could find some that support yours. In the end, we both wasted our time looking for the research!!!

The whole point of the bill is to make sure they don’t get life sunshine.
Ohh, honey...no. When did they stop teaching comprehension as a part of reading?

The point of the bill is so they don't get the charge elevated to aggravated murder, which has a mandatory life sentence. They can still get a life sentence with a murder 1 charge, but it allows the court to look at the totality of the circumstances when sentencing. Which vary case to case.
