He is also still employed so he is
1. Required to answer questions honestly or give up his pension.
2. Unable to speak to the public without giving up his pension.
So I understand Comey with the late reopening of Clinton investigation, and rapidly closing it out now. NY field office had the emails, requesting that 7th floor reopen the investigation. They refused for over a month. NY field office threatened to go public, so McCabe opened it, brushed off the emails in a week, and closed it back down.
