I think Trump will now probably just use other means to collect those tariffs. It could get messy though if we have to issue refunds on the billions we've already collected?

What's up with the Robert's SUPCO anyway? 🤔

It’s in the constitution that he doesn’t have the power. I’m not surprised

He has the power, but has to use it differently. He can't levy tariffs under this statute (IEEPA) but he can collect tariffs under different statues.

The International Emergency Economic Powers Act (IEEPA) allows the U.S. president to regulate international commerce during a national emergency but not tariffs, which are levied primarily by Congress.
