I know they only have to send it to his last known address, but, really, I wonder where they could have sent it, and know that he got it, since he left town? I guess they sent a copy to Pence. I guess the part that got my attention, was where they accused him of damang the good name of UL. That one might be a little tough to prove. [laughing]

As someone who has served as an expert witness on several wrongful termination lawsuits, I can tell you that I see zero chance Pitino wins this.

If they offer him any type of settlement, he needs to JUMP on it.
OT...I have been doing some expert witness work and I may have my first court appearance in a few weeks. Any good advice. All my other cases (5) were settled or dismissed

What struck me is that it says they will continue to pay him until the 16th. Guessing they rescinded the “without pay” portion of his leave to avoid the wrongful termination suit.

How exciting for you.

The main piece of advice is simple. Be relaxed and confident.

Remember that it is OK to say "I don't know" to a question - definitely much better than guessing. No one can know everything.

I have also have had success telling the examining attorneys "I don't understand the question" and asking them to restate it when they try to pull a complicated "gotcha" on me. Those guys usually have scripts they like to stick to and doing this gives me time to think and sometimes makes them drop the question altogether.

My favorite part of the letter was the part about damaging "the good name and reputation" of the employer. That's a good one. If they did something so bad that it damaged Louisville's name and reputation, it must be much worse than what we've heard so far.

Only advice I can give is to watch a lot of Perry Mason episodes and take notes. Use his methods, then no matter how the trial seems to be going, just hang in there for at least 56 minutes. That's when the guilty party will confess, and you look like the hero. Remember... patience... you will have to wait 56 minutes to win the trial.

Edit: I now realize that you were asking for advice regarding being an expert witness. My advice above will probably not be of any benefit to you. However, I'll leave it up for any new attorneys who might want to read it.
