OT - Need some ideas. Daughter got a speeding ticket.

Ok, my 20 year old daughter got a speeding ticket (in Nebraska as a resident). She is on our insurance but she pays her portion of the bill. She was speeding, no doubt. The cost of the ticket is not a big factor to me as she is going to pay for that. I am more worried about insurance going up, and how it will effect the rest of the family's insurance cost.

Need advice as I have never gotten a speeding ticket. What should I tell her to do regarding the ticket?
  • just pay it and pay the increase in car insurance? My guess is that will be a huge increase.
  • Go to court date & hope the LEO doesn't show (automatic not guilty right?)
  • Go to court and ask them to drop it down to a non moving citation. (is that possible 80mph in a 65 zone)
  • Are there classes she can take that will allow the ticket to never show up on her record?
We can't afford an attorney (well I can but she can't :p & daddy isn't going to fix it for her) so this is all on her. Just trying to find all her options and leave it all up to her.

This is her first speeding citation and our families first ever.

Go to court, prosecutor generally wont want to bother with a trial for a 15 mph over the speed limit and will offer some kind of plea bargain where you plead to a non moving violation. I did this successfully at least 3 different times in various jurisdictions. Compared to the DUIs and wreckless driving cases, you look like a boy (or girl) scout.

Go to the hearing 9 out of 10 times the officer or the magistrate will drop the speed so she won’t get points. That’s why you have to make sure they are respectful to the officers when they get pulled over

If we’re talking about Lincoln/Lancaster County, this definitely isn’t going to work. It will just piss the prosecutor off. Just take the stop class. The ticket is gone. Poof.

She is a good kid. She worked for a year saving up $ to buy her own car. She pays her own insurance, gas, everything. No free rides in our house. I make all my girls pay for their car, gas, & insurance even when they are/were in high school. Best way to learn.

She knows, next time she is off our insurance. Tough love is the necessary some times.

Does the county she was caught speeding have a de versions program? If it does telll her to take the class and I believe the ticket is tossed like it never happened

So does she contact the county soon to ask about the stop class and ask if she can get it before the court date then? Or does she need to have taken the class before her court date? It is in Lancaster County. She was respectful & never been in trouble.

My 20 yr old daughter got her first speeding ticket 1+ yr ago. Officer (LPD) mentioned the stop class and gave her a flyer or something. If didn’t get then see link:

Edit: Take it online. Painful 4 hours and she will have to pay attention as they test throughout. Better than old 8 hours in live classroom with Nebraska’s finest...

Yes you need to take it before the court date. Two of my kids have done it. Lucky you are in Lancaster so it's a local class and don't have to drive a long way. My experience is the officer gave them the stop class info.

Might have to call the county attorney office and get class dates and times and place. Don't forget about it. They can fill up and needs to be done before court date.

Have to take it before the court date i believe.

Does Ne. have a prayer for judgement?
A prayer for judgment, or what is often referred to as a PJC, means that although a person pleads guilty, or is found guilty, the court does not enter the conviction. This spares the defendant of paying fines and from receiving driver's license points and insurance points.

Can she meet with the prosecutor?
Since it’s a matter of public record, expect attorneys to mail or contact her.
Best of luck to her, it’s a life lesson.

Based on other responses, guessing it's slightly different in NE than it is here in IL, but both times I have received a ticket I plead guilty and requested Court Supervision. In my case, that just meant paying an extra $100 and being on supervision for 3 or 6 months where I couldn't get a other ticket or my case would be reopened. As long as you don't get another ticket, the case is dismissed pre judgement and the insurance company never finds out about it and it doesn't go on your record. Sometimes judges will require a defensive driving course as well but they didn't for me in either case, one was failure to reduce speed to avoid an accident and the other was speeding. The speeding ticket was actually in a neighboring county, and as soon as I got home I called their States Attorney's Office and asked if I would be able to request supervision without needing to show up for a court date, explaining I worked in corrections for a neighboring judicial circuit so getting time off for a court date might be difficult. They thought it was hilarious that I called a literal half hour after getting the ticket, and gladly sent me the paperwork in the mail to eliminate one case off their load for a future court date.

Do the diversion, stop class and you'll be fine. Record should be good.

I’m an insurance professional. Most companies only look back three years. If there are no other tickets or accidents and she has a preferred rate, then one ticket will have little to no impact on insurance. Have her pay the ticket and go on with life. It’s not a big deal. If she continues to get tickets, or accidents, then it’s time to be concerned. But one ticket... let it go, it’s not a big deal. If you want more detail message me.

80 mph is getting up there in my little world; she should worry more about the safety than the $$, so that class sounds useful

Up here in Michigan, the local government wants your $ more than anything else. If your driving record is clean, plead to a non moving violation like blockading or defective equipment. Here, you pay a fine, it’s zero points, and insurance companies never know. And your record remains clean.

How will your insurance company even find out? Unless they decide to randomly audit your policy, they won’t even know about it.

I’m not bragging, and it’s been well over a decade since I got a speeding ticket, but my insurance premiums never went up.

Most companies will usually run MVR’s when processing the renewals.

I worked with a guy that used to be an auditor for one of the big insurance companies (can’t remember if was Farmer’s or State Farm). He said unless you apply for new coverage, they won’t do look-backs for tickets. Maybe it’s changed now, but I’d be surprised if one speeding ticket affects your premiums.

I drive about 8-9 miles over the speed limit here in Washington and the cops never give me a second look. The Saturday before Christmas I drove completely across Seattle and the east side suburbs on my way home. I was keeping up with the flow of traffic at 10-15 mph above the speed limit the whole way. I am back in Nebraska every year, mostly I 80, South Central Nebraska plus about 80% of the time I drive back and forth from DIA. I actually drive a little faster on these trips and have never had a problem. I got pulled over in Western Kansas several years ago going 72 in a 60 zone. One look at my Washington State drivers license and the nice officer thanked me for visiting his state. That was the only time I’ve ever been stopped back there since I moved away 40 years ago.

My kid had one wreck and one 8 mph ticket in 12 months. We got dropped entirely despite our agent appealing. They wouldnt even keep us when I offered to drop him from the policy.

Sounds like I need you for an agent!

If she doesn't have any tickets in the last 3 years and is eligible...take the STOP class. Well worth it...especially at that age where the insurance increase will be significant.
