OT: SC Supreme Court overturns Murdaugh guilty verdict

Orders a new trial.

It's a good call. I personally believe he's guilty as sin. However, the prosecution did not do a very good job of proving it. Not nearly beyond a reasonable doubt. He's very unlikable and people wanted him to be guilty, so he was found guilty. I think the prosecution only proved that he COULD have done it, but that's not the bar. Again, think he's guilty but don't think the prosecution proved it beyond a reasonable doubt.

It really doesnt matter. He essentially in prison for the rest of his life for the financial crimes he plead guilty to. Hes 57 right now and has ~40 years left and even if he only serves 85% of that, he would be in his 90s before he could potentially be released which given his physical shape that would be unlikely. He is most likely going to die in prison one way or another.

I feel bad for the family of his deceased wife. They have to go back through the trauma again.

Yeah. I guess they should re-try it as it will likely yield the same verdict, no matter the evidence submitted by the prosecution.

To your point: is it worth it, though? You rightly note he's most likely going to be behind bars the rest of his life anyway. Everyone already thinks he's guilty anyway.

Edit: I guess it matter as to which kind of prison he spends the rest of his life in.

Just reading that article, it seems a small thing to overturn a verdict over. But its only one article.

Yeah, didn't really have to do with the case itself. The bozo clerk just showed evidence to jurors and led them to believe he was guilty (which he is I believe). I just never thought the prosecution proved things beyond a reasonable doubt.

Didn't follow the case as closely as some. But the clerk was sharing evidence? I do remember she got busted putting a book deal together behind the scenes.

I believe she showed the photos to journalists and made comments about his credibility as a witness to the jurors. These were the basis for the SCSC overturning since they believe the clerk attempted to bias them. She was convicted of lying about it to the court during an investigation into her misconduct.

That's not the standard for an appeal. The standard is whether appealable errors were made during the trial that gives the defendant grounds for a new trial (i.e. Objections not granted, Rulings on Motions wrongfully denied). An appeal is not a re-trial with regard to guilt or innocence. Otherwise, there would be millions of Defendants getting out on appeal. My reading of the opinion indicates that there was jury tampering on the part of the Colleton Clerk of Court which denied the defendant of his right to an impartial jury.

Those are the types of things that get cases overturned. An appeal is not a re-trial of the evidence.

Definitely guilty. I dont feel sorry for him after the pain he and his family has caused others over many years.
I know that isn't the point but I wanted you say it anyway.

I was not in the courtroom to hear and see the evidence presented by the prosecution; however he was found guilty by a jury of his peers. But as someone else has pointed out, he is not getting out of prison due to the other crimes he was found guilty.

So what happens to the clerk? She getting a raise? Similar to OJ. There could be a killer or killers still out there.

The financial crime aspect will not be as prominent.Howver,testimony by Blanca the housekeeper at the time of the murder might help gain a second conviction.
Blanca is clear she thinks he did it but had help.”Cleaners” as she called them.

Becky Hill got 3 yrs probation.
