The people paying them are not part of the institutions they will be performing services for. It would be like me paying Adrian Newey however many euros it would have taken to keep him at Red Bull just because that is my favorite team. I am not affiliated with Red Bull. He would not be performing any specific services per my instruction. He would be staying there and doing whatever the team owners told him to do.
And if they are so clever in structuring deals, how does something like the Proctor fiasco happen?

I am not going to pretend to know all the details...or even care.

The athletes will end up doing something that promotes something. That's all it takes to be a payment for work done.

But at the end of it all, why is important?

Are "NIL" payments not gifts? There is no expectation of services to be rendered for their payment. If so, shouldn't the payors be responsible for taxes above the 19k per year max?
I doubt they are considered gifts. Id argue there’s definitely an expectation of services. Also everyone gets $15M in gifts to give away before gift taxes actually matter.

Last year 15th pick was 4.9 million dollars. Rookies sign a 4-year contracts and are guaranteed for 2 years

First-round NBA draft picks sign a four-year contract. The contract structure consists of two guaranteed years followed by two team options for the third and fourth years. These rookie-scale contracts are pre-determined based on draft position, with salaries guaranteed to be between 80% and 120% of the set amount

If Iowa and the entire big ten wants to stop paying players from their revenue they certainly can.

doesn’t mean everybody will.

also, private payments from groups or companies will never be stopped going forward. You lose in court all day everyday trying to stop that.
