They would have to determine guilt vs innocence then present evidence about the crime, his ability to serve time, mental state rehabilitation and other factors.     Not a lot of white collar prisons in the state system. financial crimes would like be concurrent and earlier parole because they are non-violent.

    Surprisingly not a ton of work at the circuit level for a clerk. Most rely or request research from counsel and require submitted orders. Don’t know any circuit judges that write their own orders anymore. Too much volume.

    Typical office is a administrative assistant and law clerk. Admin stays in their home office and the law clerk typically travels the circuit with the Judge and is in the courtroom etc. Not a ton of research at the circuit level from the clerk or staff.

    No. SC only allows venue change within the circuit. No way the state wanted to go to Hampton and Barnwell likely not much better. More population to chose from and defense likely had no basis to get it in Hampton
