In criminal cases where a conflict arises from the circuit solicitor, typically those cases are either taken on by the AG's office or assigned to another circuit solicitor. This case should have been conflicted out from the very beginning, and Mr. Stone will have to answer as to why that didnt...

Typically you dont declare a death penalty case unless as someone else mentioned, there is absolutely no doubt of a guilty verdict. The filing of an appeal will happen within 10 days to start the process no matter what the sentence is. As some point Alex will file a PCR which is separate from...

@Boom4life Where are you getting that prosecutors spend less time in court? Being in front of a judge or preparing to be in front of a judge is basically the job description. Generally there are many more criminal defense attorneys (private/public eefender) than prosecutors in a given area...

How many calls, texts, web browsers opened did Alex make before calling Buster after 911. Im thinking he waited quite a while before calling his only living son and letting him know someone just brutally murdered his family. Defense has Donna Maddox on their witness list. She is a...

The problem with your hypothetical motive, is that proof of such would need to come from the lips of Alex himself or some other communication he made. Truth is, we may never know what was going on in his mind at the time. This is the instruction that the jury will likely hear on "intent"...

I think Judge Newman has done an admirable job especially considering his own son died just a few weeks before the trial started.

The FBI agent did testify along those lines. Also the prosecutors subpoenaed the records a long time ago and GM lied and said they didn't have them which is in line with what the agent testified to.

You can choose to have a bench trial, but only if the State agrees.

Regarding the notes, some judges allow notes and some don’t . There is no hard and fast rule. The judges that don’t allow it, tell jurors they want them to decide the case on what they heard and what they remember and not what another juror happened to write down.

I am actually surprised this has not already happened. Usually it is someone with a court date that they want to get our of (probably not what this one is). With all the publicity of this trial, some nut wants to join in
